On February 19, 2013 Chris Girard and Bill Dunham, Park Operations Lead Worker, inspected your garden plot and found <br />that you had failed to meet the February 18, 2013 deadline to correct the violations detailed in the February 8, 2013 <br />letter. (Violation of Park Rule 1.045(2)). Unfortunately, due to your lack of action to correct the stated violations, the <br />Community Gardens Program will not issue you a Community Garden Plot Use Permit for the 2013 gardening season <br />(February 1, 2013, through January 31, 2014). (Park Rule 1.045(e)). The Community Gardens Program will refund your <br />$100.00 Plot Use Application fee. <br />At this time I am requesting that you removal all of your personal gardening items /supplies from Mathews Garden Plot <br />#45 by Friday March 1, 2013 at 5 P.M. After this deadline any personal property remaining onsite will be removed and <br />stored for 30 days at which time it will either be recycled or disposed of as garbage . Plot #45 will be reassigned during <br />the 2013 Community Garden Plot Use Permit lottery process. <br />In accordance with Eugene Code 2.021 Appeal Procedures - you may appeal the denial of your permit application. If you <br />choose to appeal the denial of your permit application you must do so in writing to the City Manager within 15 days of <br />the date on this letter. An appeal shall state: <br />(a) The name and address of the appellant; <br />(b) The nature of the determination being appealed; <br />(c) The reason the determination is incorrect; and <br />(d) What the correct determination of the appeal should be. <br />An appellant who fails to file such a statement within the time permitted waives the objections, and the appeal shall be <br />dismissed. <br />Sincerely, J <br />Mark Schoening <br />AIC Parks and Open Space Director <br />
