3of3 <br />12 -15786 <br />I looked through the backpack and found a drug kit contained in a purple "Crown Royal" bag in the small <br />pouch of his backpack. There bag contained several syringes, some used and some new, and the bottom <br />of a soda can with burnt residue and a brown stained cotton. There were also band aids, alcohol pads and <br />small cotton balls. Kyvelos told me he uses heroin, but hadn't used in five days. He said he got "clean" <br />while he was in jail. Within a mesh, side pocket of the backpack, I located a small digital scale. Kyvelos <br />told me he found the scale on the ground. He said he thought it would be helpful for his.work <br />with "silver," but the scale wasn't working. I,tested the scale and it seemed to be functioning properly. <br />I opened the main compartment on the smaller red backpack. I found a paper bag and. a plastic bag . <br />inside. Both bags contained multiple syringes, band aids, alcohol pads and small cottons balls. I removed <br />the bags and saw a small, plastic baggie (approximately 2" x 2 ") at the bottom of the backpack. The <br />baggie contained a white, crystal like substance that appeared to be methamphetamine. When I removed <br />the baggie from the backpack, Kyvelos told me it was salt. He advised the backpack belonged to a friend. <br />Arrest /Custody . <br />I took Kyvelos into custody, double locking the handcuffs and checking them for proper fit. I read him his <br />Miranda Rights at 0042 hours. Kyvelos replied, "Yep" he understood his rights. <br />Kyvelos told me the small, red backpack belonged to his friend "Todd." He said he didn't know "Todd's" <br />last name. He said "Todd" left the backpack in the park earlier, so he picked it up and was going to take it <br />to him. Kyvelos told me he thought "Todd" was staying in a motel near W 6th Ave and Blair Blvd. I asked <br />him how he knew the substance in the plastic bag was salt if it wasn't his backpack. He told me "Todd" <br />doesn't have any money to buy drugs and he uses sea salt to sanitize his body piercings. <br />I asked Kyvelos if I could search. his person and he agreed: He told me he had a knife in his pants pocket <br />and a "rig" in his jacket. I removed a folding knife that was clipped to his right, front pants pocket. <br />Kyvelos told me it was his father's knife. I found that the knife was spring assisted. Lightly pressing on a <br />knob on the blade caused the knife to spring into the open position. Kyvelos told me he borrowed the <br />knife from his father and was bringing it back to him. Kyvelos' CCH confirmed he is a felon, prohibiting <br />him from carrying a spring assisted knife. <br />I located a small plastic bindle in his left front pants pocket. The bindle contained a small, round metal tin <br />commonly used by IV drug users. The tin contained a brown stained cotton ball and brown, burnt <br />residue. Kyvelos admitted the substance on the cotton was heroin, but stated it was old. <br />Ofc Evans field tested the white, crystal substance using Nark II test kits one and fifteen. The substance <br />tested positive for methamphetamine. Ofc Hubbard field tested a piece of the cotton ball using Nark II <br />test kit 11. The cotton tested positive for heroin. <br />I transported Kyvelos to the Lane County Jail. Ofc Evans took custody of the knife, baggie with white <br />crystal substance, bottom of the soda can with cotton, small tin with cotton and digital scale. Ofc Evans <br />photographed the items and lodged them into.evidence. The white crystal substance and small tin with <br />cotton were lodged for further testing at the OSP lab. <br />Booking: <br />I lodged Kyvelos at the Lane County Jail for the listed charges. <br />R.
