5.3 .5CI. <br /> The Solicitation Agent may refuse to disclose to the <br />ONFIDENTIAL NFORMATION <br />public information submitted by a Person which would qualify as confidential <br />information exempt from disclosure under ORS 192.401 to 192.505 if such information <br />is voluntarily submitted in response to the Solicitation Agent’s investigation of the <br />Person’s capability to meet the applicable Standards of Responsibility and the Person <br />submitting the information has clearly marked or otherwise identified in writing the <br />information that is confidential. <br />CI. <br />5.4 <br /> Pursuant to Section 14 of the Eugene Charter of 2002, no <br />ONFLICT OF NTEREST <br />elected city official may be financially interested in any contract the expenses of which are <br />to be paid by the City. No contract shall be awarded to an elected city official which is in <br />violation of the State ethics laws or city charter or code conflict of interest provisions. <br />DD. <br />5.5 <br />EBARMENT AND ISQUALIFICATION <br />5.5 .1 DPO. <br /> The city may debar a Person <br />EBARMENT FROM ROCUREMENT PPORTUNITIES <br />from consideration for award of the city’s contracts for up to three (3) years for the <br />reasons listed in subsection 5.5.2 after providing the Person with notice and a <br />reasonable opportunity to be heard. <br />5.5 .2 GD. <br /> A Person may be debarred from consideration for <br />ROUNDS FOR EBARMENT <br />award of the city’s contracts for any of the following reasons. <br />(a) The Person has been convicted of a criminal offense as an incident in obtaining <br />or attempting to obtain a public or private contract or subcontract, or in the <br />performance of a public or private contract or subcontract. <br />(b) The Person has been convicted under state or federal statutes of embezzlement, <br />theft, forgery, bribery, falsification or destruction of records, receiving stolen <br />property or any other offense indicating a lack of business integrity or business <br />honesty that currently, seriously and directly affects the Person’s responsibility <br />as a contractor. <br />(c) The Person has been convicted under state or federal antitrust statutes. <br />(d) The Person has committed a violation of a contract provision that is regarded by <br />the City or the Construction Contractors Board to be so serious as to justify <br />disqualification. A violation may include but is not limited to a failure to <br />perform the terms of a contract or an unsatisfactory performance in accordance <br />with the terms of the contract. However, a failure to perform or an <br />unsatisfactory performance caused by acts beyond the control of the contractor <br />may not be considered to be a basis for Debarment. <br />(e) The Person does not carry workers’ compensation or unemployment insurance <br />as required by statute. <br />5.5 .3 DN. <br /> The city shall issue a written decision to debar a Person. <br />ECISION AND OTICE <br />The decision must: <br />(a) State the reasons for the action taken; and <br />Article 5 General Rules for Solicitations Page 22 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
