5.2.8PFQ. <br /> The Solicitation Agent shall notify any <br />ROTEST OF AILURE TO UALIFY <br />applicant who fails to qualify for participation in a pool that it may appeal the <br />Solicitation Agent’s decision to the Contract Review Board in the manner described <br />in Article 13. <br />R. <br />5.3 <br />ESPONSIBILITY <br />5.3 .1 RO;DSA. <br /> A <br />ESPONSIBLE FFERORETERMINATION BY OLICITATION GENT <br />Responsible Offeror for a Public Contract is one who meets the Standards of <br />Responsibility for the contract.Prior to awarding a city contract, the Solicitation <br />Agent should determine that the apparent lowest or best Offeror meets the Standards <br />of Responsibility. <br />5.3 .2 SRD. <br /> An Offeror meets the Standards of <br />TANDARDS OF ESPONSIBILITY EFINED <br />Responsibility if the Offeror has: <br />(a) Available the appropriate financial, material, equipment, facility and personnel <br />resources and expertise, or ability to obtain the resources and expertise, <br />necessary to indicate the capability of the Offeror to meet all contractual <br />responsibilities; <br />(b) A satisfactory record of performance. The Solicitation Agent shall document <br />the record of performance of an Offeror if the Solicitation Agent finds the <br />Offeror to be non-responsible under this paragraph; <br />(c) A satisfactory record of integrity. The Solicitation Agent shall document the <br />record of integrity of an Offeror if the Solicitation Agent finds the Offeror to be <br />non-responsible under this paragraph; <br />(d) Qualified legally to contract with the city; <br />(e) Supplied all necessary information in connection with the inquiry concerning <br />responsibility; <br />(f) Not been Debarred by the city; and <br />(g) Has complied with requirements under the Solicitation, if any, to make good <br />faith efforts as prescribed in ORS 200.045(3) concerning small business <br />enterprises. <br />5.3.3I. <br /> The Solicitation Agent may investigate any Offeror or applicant for <br />NVESTIGATION <br />prequalification to determine whether the Offeror or applicant for prequalification <br />meets the Standards of Responsibility, or to discover whether previously Debarred <br />Persons or their principal owners, through a change of ownership or another <br />adjustment in form or appearance, are seeking an award of a contract that would <br />avoid application of the Standards of Responsibility or of a Debarment determination. <br />5.3 .4RI. <br />If a Person fails to promptly supply information <br />ESPONSE TO NVESTIGATION <br />requested by the Solicitation Agent concerning responsibility, the Solicitation Agent <br />shall base the determination of responsibility upon any available information or may <br />find the Offeror not responsible. <br />Article 5 General Rules for Solicitations Page 21 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
