(a) A statement of whether the applicant has been prequalified, and if <br />prequalification has been denied, the Standards of Responsibility that the <br />applicant failed to meet which form the basis for denial. Unless the reasons are <br />specified in the notice, the applicant shall be deemed to have been prequalified <br />in accordance with its application; <br />(b) A description of the contract or types of contracts for which the applicant is <br />qualified to compete, the period of time for which the prequalification shall be <br />valid, and any other conditions of the prequalification; and <br />(c) A description of the applicant’s right to appeal a denial of prequalification to the <br />Board under these regulations. <br />5.1 .6ADP. <br /> Appeals of prequalification decisions <br />PPEAL OF ENIAL OF REQUALIFICATION <br />will be conducted under the procedure described in Article 13. <br />5.1 .7RP. <br /> If the Solicitation Agent subsequently <br />EVOCATION OF REQUALIFICATION <br />discovers that a Person who was prequalified is no longer qualified, the Solicitation <br />Agent may revoke the prequalification upon reasonable notice to the applicant, except <br />that a revocation is invalid as to any contract for which an advertisement for Bids or <br />Proposals has already been issued. <br />5.1 .8PSR. <br />REQUALIFICATION AND TANDARDS OF ESPONSIBILITY <br />5.1 .8 .1 Non-Waiver. <br /> The fact that a Person is prequalified to submit a response to a <br />contract Solicitation is not a waiver of the Standards of Responsibility and the <br />Solicitation Agent shall not award a contract to a Person who does not meet the <br />Standards of Responsibility for a contract at the time of contract award. <br />5.1 .8.2 Qualified Pools. <br /> The Standards of Responsibility for a Qualified Pool shall <br />include, in addition to other items, the applicant’s agreement to all terms and <br />conditions of participation in the Pool. <br />5.1 .8 .3Effect of ODOT and DAS Prequalification. <br /> The fact that a Person has been <br />prequalified by ODOT or by DAS is a rebuttable presumption that the Person is <br />qualified for the type of work described in the ODOT or DAS prequalification, <br />but it does not waive the necessity for the Person to comply with the city’s <br />prequalification requirements, including, but not limited to, the requirement for <br />proof of insurance or agreement to the terms of a Qualified Pool contract. A <br />Person may submit its proof of prequalification with its application to establish <br />its basic qualification for the type of work. <br />QP. <br />5.2 <br />UALIFIED OOLS <br />5.2 .1 PQP. <br /> In lieu of prequalification on a contract-by-contract <br />URPOSE OF UALIFIEDOOLS <br />basis, the city may establish Qualified Pools that can be used on a continuous basis <br />for the selection of contractors when direct appointment or Informal Solicitation is <br />otherwise authorized by these regulations. <br />Article 5 General Rules for Solicitations Page 19 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
