(a) The contract results from an unsolicited Proposal to the city based on the unique <br />attributes of the property or the unique needs of the proposer; <br />(b) The proposed use of the property is consistent with the city’s use of the property <br />and the public interest; and <br />(c) The city reserves the right to terminate the contract without penalty, in the event <br />that the city determines that the contract is no longer consistent with the city’s <br />present or planned use of the property or the public interest. <br />4.8.17UP. <br /> A Solicitation Agent, for Procurements up to $20,000, and the <br />SEDROPERTY <br />Purchasing Agent, for Procurements in excess of $20,000, may contract for the <br />purchase of used property by negotiation if such property is suitable for the city’s <br />needs and can be purchased for a lower cost than substantially similar new property. <br />For this purpose the cost of used property shall be based upon the life-cycle cost of <br />the property over the period for which the property will be used by the city. A record <br />shall be made of the Findings that support any purchase over $10,000. <br />4.8.18U. <br /> Contracts for the purchase of steam, power, heat, water, telecommunications <br />TILITIES <br />Services, and other utilities, including in-kind telecommunications Services pursuant <br />to Eugene Code 3.415(6). <br />CREC <br />4.9. <br />ONTRACTSEQUIRED BY MERGENCYIRCUMSTANCES <br />4.9 .1 IG. <br /> The Purchasing Agent may declare that an Emergency exists. The <br />NENERAL <br />Purchasing Agent shall notify the city council of the declaration of Emergency as <br />soon as reasonably possible. Upon the declaration of an Emergency, the Purchasing <br />Agent may execute a contract. <br />4.9.2R. <br /> The Solicitation Agent shall make a record of (i) the nature of the <br />EPORTING <br />Emergency; (ii) the method used for selection of the particular contractor, including a <br />solicitation time period that the Purchasing Agent determines to be reasonable under <br />the Emergency circumstances as well as Informal Solicitation and direct appointment <br />methods in the case of extreme necessity; and (iii) the reason why the selection <br />method was deemed in the best interest of the city and the public. A copy of the <br />record shall be placed in the city’s file. <br />4.9.3AC. <br /> A contract awarded under Emergency conditions must be <br />WARDING OF ONTRACTS <br />awarded within sixty (60) days following the declaration of an Emergency unless the <br />city council grants an extension of the Emergency period. When the delay associated <br />with obtaining a payment or performance bond would result in injury or substantial <br />property damage, the Purchasing Agent may waive, wholly or in part, the requirement <br />for a payment or performance bond. <br />FPP <br />4.10. <br /> Goods and Services may be purchased without <br />EDERAL URCHASING ROGRAMS <br />competitive procedures under a local government purchasing program administered by the <br />GSA in accordance with the following rules of the Purchasing Agent. <br />Article 4 Classes of Contracts Page 15 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
