ARTICLE 2 <br />CONTRACTING AUTHORITY <br />C'CA <br />2.1. <br /> The city shall exercise all rights, powers and <br />ITYSONTRACTING UTHORITY <br />authority of the city and a local contracting agency under the Oregon Public Contracting <br />Code. <br />RCC. <br />2.2 <br /> The city council has reserved to itself the exercise <br />EGULATION BY ITY OUNCIL <br />of all of the duties and authority of a contract review board under the Oregon Public <br />Contracting Code, including, but not limited to, the power and authority to: <br />2.2 .1 SMAC. <br /> Approve the use of <br />OLICITATION ETHODS PPLICABLE TO ONTRACTS <br />contracting methods and exemptions from contracting methods for a specific contract <br />or certain classes of contracts; <br />2.2 .2 BNS. <br /> Exempt the use of brand name Specifications for <br />RAND AME PECIFICATIONS <br />Public Improvement contracts; <br />2.2 .3 WPPB. <br /> Approve the partial or complete <br />AIVER OF ERFORMANCE AND AYMENT ONDS <br />waiver of the requirement for the delivery of a performance or payment bond for <br />construction of a Public Improvement other than in cases of emergencies; <br />2.2 .4 EAPC. <br /> Authorize the use of <br />LECTRONIC DVERTISEMENT OF UBLICONTRACTS <br />electronic advertisements for Public Contracts in lieu of publication in a newspaper of <br />general circulation; and <br />2.2 .5 ADPD. <br /> Hear properly filed <br />PPEALS OF EBARMENT AND REQUALIFICATION ECISIONS <br />appeals of the Purchasing Agent’s determination of Debarment, or concerning <br />prequalification. <br />ARPA <br />2.3. <br /> (EC 2.1415). The <br />UTHORITY AND ESPONSIBILITY OF URCHASING GENT <br />Purchasing Agent has the following authority and responsibility: <br />2.3 .1GA. <br /> The Purchasing Agent is authorized to award all city <br />ENERAL UTHORITY <br />contracts for which there is an appropriation. Subject to the provisions of EC 2.1400 <br />to 2.1450, the Purchasing Agent may adopt and amend all rules, regulations, <br />procedures and forms required or permitted to be adopted by the city under the <br />Oregon Public Contracting Code or otherwise convenient for the city’s contracting <br />needs. Without limiting the generality of the foregoing, the Purchasing Agent shall <br />adopt Public Contracting rules for the award of Personal Services Contracts and <br />Concession Agreements and shall hear all Solicitation and award protests. <br />2.3 .2PS. <br /> When adopting rules, the Purchasing Agent shall establish <br />ROCEDURAL TANDARDS <br />practices and procedures that: <br />Article 2 Contracting Authority Page 4 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
