DCF <br /> means any revenue, money or that which can be valued in money <br />IRECT ITYUNDING <br />derived from the city's immediate custody and control for the specific purpose of financing a <br />project. Payment for all or part of a project with city property or other assets constitutes payment <br />with city funds. <br />D <br /> means any arrangement for the transfer of property by the city under which the city <br />ISPOSAL <br />relinquishes ownership. <br />E <br /> means circumstances that could not have been reasonably foreseen; create a <br />MERGENCY <br />substantial risk of loss, damage or interruption of Services or a substantial threat to <br />property, public health, welfare or safety; and require prompt execution of a contract to <br />remedy the condition. <br />ESPCESPC <br /> means a contract with a qualified <br />NERGYAVINGS ERFORMANCE ONTRACT <br />OR <br />energy service company for the identification, evaluation, recommendation, design and <br />construction of energy conservation measures that guarantee energy savings or performance. <br />F <br />mean statements of fact that provide justification for a determination to exempt a <br />INDINGS <br />Public Improvement contract from competitive bidding. Findings must demonstrate that (i) it <br />is unlikely that an exemption will encourage favoritism or substantially diminish competition <br />and (ii) the awarding of a contract under the exemption will likely result in substantial cost <br />savings. The Findings may include, but not be limited to, information regarding operation, <br />budget and financial data; public benefits; cost savings; competition in Public Contracts; <br />quality and aesthetic considerations, value engineering; specialized expertise needed; public <br />safety; market conditions; technical complexity; availability and number of persons to bid; type, <br />cost and amount of the contract; performance and funding sources. <br />FP <br />means a Proposal submitted in response to an RFP. <br />ORMAL ROPOSAL <br />FPA <br />means Direct City Funding and Indirect City Funding and <br />UNDS OF A UBLICGENCY <br />any other funds of a Public Agency. Funds of a Public Agency do not include: <br />(a) A waiver of building and development permit fees by the city; <br />(b) Funds provided in the form of a government Grant to a Nonprofit Organization, <br />unless the government Grant is issued for the purpose of construction, reconstruction, <br />major renovation or painting; <br />(c) Tax credits or tax abatements; <br />(d) Land that a Public Agency sells to a private entity at fair market value; <br />(e) The difference between: <br /> (i) The value of land that a Public Agency sells to a private entity as <br />determined at the time of the sale after taking into account any plan, <br />requirement, covenant, condition, restriction or other limitation, exclusive <br />of zoning or land use regulations, that the Public Agency imposes on the <br />development or use of the land; and <br /> (ii) The fair market value of the land if the land is not subject to the <br />limitations described in subparagraph (i) of this paragraph; <br />Article 18 DefinitionsPage 94 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
