Works has been paid less than the prevailing rate of wage or less than the <br />minimum hourly rate of wage specified in the contract. <br />16.8 .2 .2 Retainage Until Certified Statements Filed. <br /> For Public Works contracts first <br />advertised or solicited on or after January 1, 2006, the city shall retain twenty-five <br />percent (25%) of any amount earned by the contractor on the Public Works <br />project until the contractor has filed the certified statements. The city shall pay <br />the contractor the amount retained within fourteen (14) days after contractor files <br />the certified statements. The contractor shall retain twenty-five percent (25%) of <br />any amount earned by a first-tier subcontractor on a Public Works project until <br />the first-tier subcontractor has filed the certified statements. The contractor shall <br />verify the first-tier subcontractor has filed the certified statements before the <br />contractor pays the subcontractor the amount retained, which shall be within <br />fourteen (14) days after the first-tier subcontractor files the certified statements. <br />16.8 .2 .3 Verification Under Oath. <br /> The certificate and statement shall be verified by the <br />oath of the contractor or the contractor’s surety or subcontractor or the <br />subcontractor’s surety that the contractor or subcontractor has read the statement <br />and certificate and knows the contents thereof and that the same is true to the <br />contractor or subcontractor’s knowledge. <br />16.8 .2 .4 Inclusion of Payroll Records. <br /> The certified statements shall set out accurately <br />and completely the payroll records for the prior week, including the name and <br />address of each worker, the worker’s correct classification, rate of pay, daily and <br />weekly number of hours worked, deductions made and actual wages paid. <br />16.8 .2 .5 Due Date for Filing with City. <br /> The contractor or subcontractor shall deliver or <br />mail each certified statement required by this subsection 16.8.2 to the city. <br />Certified statements for each week during which the contractor or subcontractor <br />employs a worker upon the Public Works shall be submitted once a month, by the <br />fifth Business Day of the following month. Information submitted on certified <br />statements may be used only to ensure compliance with the provisions of ORS <br />279C.800 to 279C.870. <br />16.8 .3 RCD;DP. <br /> The <br />EQUESTS FOR OMMISSIONER ETERMINATIONSIVISION OF ROJECT <br />Solicitation Agent may request a determination from the Commissioner of the Bureau <br />of Labor and Industries about whether a project or proposed project is or would be a <br />Public Works project on which payment of the prevailing wage rate is or would be <br />required under ORS 279C.840 or a project that may or should be divided under ORS <br />279C827. <br />PCPB. <br />16.9 <br />Pursuant to applicable State laws <br />ROVISIONSONCERNING UBLICUILDINGS <br />and administrative rules, before entering into a public improvement contract for <br />construction of a public building or for the reconstruction or major renovation of a public <br />building, the City shall prepare a written determination of whether the inclusion of solar <br />energy technology in the construction, reconstruction or major renovation of the public <br />Article 16 Contract Administration Page 88 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
