the manner in which Offerors may modify of withdraw their Bids prior to <br />Closing; and <br />11.2 .20 BAPP. <br /> A description of the manner in which the city <br />IDWARD AND ROTEST ROCESS <br />will issue its notice of intent to award and the manner in which aggrieved bidders <br />may protest the award. <br />11.2 .21 ARPI. <br />DDITIONAL EQUIREMENTS FOR UBLICMPROVEMENTS <br />11.2 .21 .1 Bid Closing. <br /> The Closing for a Public Improvement Solicitation may not be <br />less than five (5) days after the date of the last publication of the advertisement. <br />In addition, if the estimated Contract Price exceeds $100,000, the Closing must <br />be set between the hours of 2 p.m. and 5 p.m. on a Tuesday, Wednesday or <br />Thursday unless the contract is for maintenance or construction of highways, <br />bridges or other transportation facilities. <br />11.2 .21 .2 Submission and Receipt of Bid by Electronic Means. <br /> If the Solicitation is for <br />a Public Improvement, the city, in its sole discretion may direct or permit the <br />submission and receipt of Bids by electronic means. <br />11.2 .21 .3 Contractor’s License. <br /> If the Solicitation is for a Public Improvement, a <br />statement that a Bid for a Public Improvement contract may not be received or <br />considered by the city unless the bidder is licensed by the Construction <br />Contractors Board or the State Landscape Contractors Board and a place for the <br />bidder to submit all required license numbers or registration information. <br />11.2 .21 .4 First Tier Subcontractor Disclosure. <br /> The Invitation to Bid for a Public <br />Improvement contract with an estimated Contract Price of $100,000 or more <br />must include the information and form described in Section 11.4 of these <br />regulations, and a statement that a Bid will be considered non-Responsive and <br />ineligible for award if the bidder does not submit a subcontractor disclosure <br />form in the manner and within the time required by ORS 279C.370 (described <br />in these regulations). <br />11.2 .21 .5 Drug Testing Certificate. <br /> Each Bid for a Public Improvement contract must <br />contain a certification from each bidder that it has and will maintain during the <br />performance of the contract, an employee drug testing program. <br />11.2 .21 .6 Wages for Public Works. <br /> If the contract is for a Public Works project subject <br />to the state prevailing rates of wage under ORS 279C.800 to 279C.870, the <br />federal prevailing rates of wage under the Davis-Bacon Act (40 U.S.C. 276a) or <br />both the state and federal prevailing rates of wage: <br />(a) The Specifications for the work must contain a provision stating the <br />existing prevailing rate of wage that must be paid to workers in each trade <br />or occupation required for the Public Works employed in the performance <br />Article 11 Invitations to Bid Page 49 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
