11.2 .14 .1 Examples of Special Requirements. <br /> Examples of special requirements <br />include, but are not limited to environmental impacts, transportation costs, <br />volume weighing, trade-in allowance, depreciation allowances, cartage penalties <br />and ownership or life cycle cost formulas <br />11.2 .14 .2 Product or Service Acceptability. <br /> The Solicitation Documents shall set forth <br />the criteria to be used in determining product or Service acceptability. The <br />Solicitation Agent may require the submission of samples, descriptive literature, <br />technical data, or other material, and may also require any of the following prior to <br />award: <br />(a) Demonstration, inspection or testing of a product or Service prior to award <br />for such characteristics as quality of workmanship; <br />(b) Examination of such elements as appearance, finish, taste, feel ability to <br />be recycled or reused; or <br />(c) Other examinations to determine whether the product or Service conforms <br />to the Solicitation Documents. <br />The acceptability evaluation is conducted only to determine that a Bid is <br />Responsive to the Solicitation Documents. A bidder’s product or service that <br />does not meet the minimum requirements may be rejected in the city's <br />discretion. Product or Service rejections are not considered bidder disqualifications <br />and are not grounds for appeal under state law; <br />11.2 .15 C’RCD. <br /> A statement that the city may reject for good <br />ITYSIGHT TO ANCEL OR ELAY <br />cause any or all Bids and/or cancel or delay or suspend the Solicitation or award at <br />any time prior to execution of the contract upon the city's determination that it is in <br />the public interest to do so, and a statement that the cost of submission of a Bid is not <br />recoverable upon such rejection, delay or cancellation; <br />11.2 .16 B;PPB. <br /> Bid security requirements of Section <br />IDERFORMANCE AND AYMENT ONDS <br />6.6, if any, and Performance and Payment bond requirements of Section 15.1, if any; <br />11.2 .17 TC. <br /> All terms and conditions of the Contract, including all <br />HEONTRACT <br />Specifications; <br />11.2 .18BF. <br /> A Bid form that contains the following statements, to be acknowledged <br />IDORM <br />by execution, by the bidder: <br />11.2 .18 .1 Certificate of Non-Discrimination in Subcontracting. <br /> A statement that the <br />bidder has not and will not discriminate against a subcontractor in the awarding <br />of a subcontract because the subcontractor is a minority, a woman or an emerging <br />small business enterprise certified under ORS 200.055. <br />Article 11 Invitations to Bid Page 47 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
