(b) The estimated amount of the Procurement; <br />(c) The name of the Administering Contracting Agency; and <br />(d) A time, place and date by which comments must be submitted to the <br />Solicitation Agent regarding the intent to make a purchase through a <br />permissive cooperative Procurement. <br />9.4 .2 .2 Time of Notice. <br /> The notice shall be published at least three (3) Business Days <br />before the deadline for submission of comments. <br />9.4 .2 .3 Responses to Notice. <br /> If the Solicitation Agent receives comments in the <br />manner provided in the notice, the Solicitation Agent shall not proceed with the <br />cooperative Procurement unless s/he determines that the Procurement is in the <br />best interest of the city and provides a copy of the written determination to any <br />vendor that submitted comments prior to execution of the contract. <br />ICP <br />9.5. <br />NTERSTATE OOPERATIVE ROCUREMENTS <br />9.5 .1 WE. <br /> The city may use an interstate cooperative Procurement only if: <br />HENLIGIBLE <br />(a) The Administering Contracting Agency’s Solicitation procedure, Solicitation <br />Documents and the original contract allows other governmental bodies to <br />establish contracts under the terms, conditions and prices of the original <br />contract; and <br />(b) The Administering Contracting Agency permits the contractor to extend the use <br />of the terms, conditions and prices of the original contract to the city. <br />(c) For purposes of this section, an Administering Contracting Agency may be any <br />governmental body, domestic or foreign, authorized by law to enter into contracts <br />for the Procurement of Goods and Services for use by a governmental body. <br />9.5 .2WNE <br />.The city may not use an interstate cooperative Procurement <br />HENOTLIGIBLE <br />for a Public Improvement contract. <br />9.5 .3 WNR. <br /> The city shall advertise a notice of intent to use interstate <br />HENOTICE EQUIRED <br />cooperative Procurement, in the manner provided in subsection 7.2.1, at any dollar <br />threshold unless: <br />(a) The city, or the cooperative Procurement group of which the city is a member is <br />listed in the Solicitation Documents of the Administering Contracting Agency <br />as a party that may establish contracts under the original contract, and <br />(b) The Solicitation has been advertised in Oregon; the city, or the cooperative <br />Procurement group of which the city is a member. <br />The notice required by this subsection shall provide potential vendors an opportunity <br />to comment and shall contain the type of information required under subsection <br />9.4.2.1. <br />Article 9 Cooperative Procurements Page 41 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
