Any conu=t or <br />permit that authorizes another telecommunications carrier to use any of the Monopole shall <br />require the user to pay a pro-rata, share of the costa of Monopole maiatcnance. <br />Section 2. Term. Unless earlier terminated as provided herein, this License will run for -a <br />term that commences on the date executed by the City and expires at midnight on December 31 <br />of.the'year in which the twenty-fifth anniversary of the t date occurs. <br />Section 3. I,leense Fees. Sprint FIGS shall pay an annual license fee, due in advance of each <br />year, on January 1. The license fee for the year ending on December 31, 2004 shall be pre=rated <br />on a daily basis and shall be delivered to City prior to City's execution of this Agreement. The <br />2004 license foe shall be an annual fee of $2,000 (for 364 days}. The license fee will be <br />increased to be 103% of the previous annual license fee. on Jam 1, ZOOS And on each <br />subsequent January i during the term of this Amt. <br />Section 4 Improvements. <br />0~ 3X~n+ C~~041j~- <br />(a) Monopole Replacement. City hmvby mmts to the replacement of its existing <br />pole #23690 with a new Monopole that shall not exceed seventy-eight (?S) feet in height, subject <br />to the following conditions: <br />(i) The Monopole shall be built with materials specified by City; so long as such <br />materials are consistent with standards' of, and gencrally acted in, the <br />telemmmunications industry. <br />(ii) Sprint PCS shall be responsible for emoviog snd.replacing Cityy's street light <br />and appurtenam electric utility on the MottWle in the location and Ire mor approved by <br />city-, <br />(iii) Spr w PCS shall make separate arrangements with the electric utility serving <br />the monopole for its own electric service and shell not use the City's, electric service <br />(iv) All costs ineutied by Sprint PCS in connection with the replacement of the <br />monopole shall be considered expenditures far tenant itUFR - avements and <br />(v) All of ft requirements for Licensdee eats in subsection 4(b) will be. <br />complied !with; <br />(b) Improvements, Generally.
