The Norkenzie pole is owed by the City, the other taro poles are owned by the Eugene
Wxw and Electric Board_ All three are sited in the public ROW which the City manages. When we
wed into the agreements w& Qwest, the City was in litigation, prevented from using the
Registration and Licensing procedures outlined in Ordinance 20093 for use ofthe ROW. The City
used a Revocabie Permit instead.
That litigation has since been concluded, in the City's favor, and the City has returned to the rise of
the Registration instrumctet in cases such as ROW co-locations; we ttansitioned the revocable permits
to liegistrations. Qwest and Sprint are registered under Ordinance 20083, thereby negating the need
for the revocable permit or ROW annual payments that might have been regWM by that permit.
hA matioa about Ordinance 20093 can be found at warw.d.eueene.or.usftele~mn
Ifyou have any questions or desire additional information, please let me know.
'T'hank you,
Pam Berrien
Franchise Manager
Cc_ Rands] Dade, Public Works Dept
Mark Oberie, EWLB
