. • • <br />4.3 Commencement of Term. This sublease shall commence upon substantial <br />completion of the New Tower and the New Equipment Building. The Sublessors must notify the <br />Sublessee of the anticipated commencement of the sublease term not less than 10 days prior to the <br />commencement of such term. The Sublessee will have the right after the date of such notice to <br />install the Sublessee's Transmission Facilities on the New Tower and in the New Equipment <br />Building, so long as this is done in a manner that does not unreasonably interfere with the <br />Sublessors' completion of the construction. <br />5. Use of the Premises. <br />5.1 Permitted Use. The Sublessee's use of the Premises may be for the sole purpose of <br />constructing, using, monitoring, and maintaining the Sublessee's Transmission Facilities described <br />in Section lof this sublease. <br />5.2 Access. Easements and Road Rights. Sublessors warrant that they have the right <br />to access the Premises by virtue of easements and public road rights. Sublessors grant to Sublessee, <br />a nonexclusive license to use the easements and road rights of the Sublessors for access to the; <br />Premises, which rights will be subject to the obligations and restrictions imposed on the use of such <br />easements and roads by the Sublessors. Sublessees shall contribute to Sublessors' cost of <br />maintaining such roads in an equitable manner as determined by the parties that takes into account <br />the relative use of the road by each user of the Premises. <br />5.3 Priority of Use. The Sublessee will not interfere with the right of the Sublessors <br />and any other person authorized by the Sublessors to use, install, or maintain equipment on the <br />Premises. Notwithstanding any other provision of this sublease, the use of the Premises by the <br />Sublessee will in all respects be subordinate to the use of the Premises by both of the Sublessors and <br />any future expansion in the use of the Premises by either or both of the Sublessors. Provided, <br />Sublessors' use shall not expand in a manner that would diminish Sublessee's rights under this <br />Sublease to use the Premises. <br />5.4 Construction and Maintenance. The Sublessee is responsible for the construction, <br />installation, and maintenance of the Sublessee's Transmission Facilities. The Sublessee will permit <br />only qualified contractors to install, maintain, and service the Sublessee's Transmission Facilities <br />and to climb the New Tower and to install, maintain, and service equipment on such tower. Such <br />contractors must be instructed not to interfere with existing equipment in any way and to in no way <br />cause damage to the property of either of the Sublessors or to property of any of any other person <br />authorized by the Sublessors to use, install, or maintain equipment on the Premises. The insurance <br />carried by any contractor working on the Premises must protect the Sublessee, the Sublessors, and <br />other persons authorized by the Sublessors to use, install, or maintain equipment on the Premises, <br />and their equipment and must be of an adequate level as designated by the Sublessors.
