In addition to the above covenants, additional restrictions may be implemented by the <br />Developer. All Lot Owners shall be given a copy of any such restrictions and acknowledge and <br />agree to be bound by those additional restrictions. <br />The Association shall have and retain the responsibility for determining if nonconformance of <br />these restrictions has occurred or is occurring and shall investigate reports of noncompliance. <br />Toward this end, the Association or its representatives shall be allowed access to any Lot to <br />investigate after notifying the Owner of the subject Lot 24 hours in advance of the visit. If <br />nonconformance is determined to have occurred or determined to be occurring, the Owner of <br />the Lot shall be notified in writing by the Association. The letter will present evidence of the <br />nonconformance, detail the Owner's responsibilities in correcting it, and establish a time period <br />within which the nonconformance must be corrected. <br />If nonconformance is not corrected within the time period recommended, and if the Owner has <br />not received a written extension or variance from the Association, the Association shall then <br />have the authority to enter the Lot, after 24 -hour notification, to cure or cause to be cured, the <br />nonconformance. If costs are incurred by the Association pursuant to their authority above, the <br />Owner of the Lot shall pay those costs. If the Owner does not promptly pay these costs at the <br />time they are incurred, the Association shall have the right to increase the Owner's yearly dues <br />by that amount. <br />SECTION 8. CONSCIENTIOUS CONSTRUCTION PRACTICES. <br />a. Parking is permitted only on paved areas or on specially designated unpaved areas. This <br />applies to private and commercial vehicles. <br />b. All vehicles and construction equipment shall be operated in such a way as to not kill <br />trees. <br />c. All work in utility easements shall be carried out within the prescribed construction <br />corridor. <br />d. On building sites, the use of heavy equipment must be confined to areas that will <br />eventually be paved (such as driveways and house footprints) or use other precautions <br />to reduce compaction. <br />e. To prevent soil contamination, designate and use washout areas only. <br />f. Consider suspending earth moving activities prior or just after periods of heavy rain. <br />SECTION 9. LOTS 10 AND 11. Lots 10 and I 1 shall be developed in accordance with <br />the Eugene Code provisions for panhandle lots. The street gate on the panhandle lot shall be <br />maintained by the Association but the expense thereof shall be borne only by Owners on Lots <br />10 and 11. The expense charged to those Owners shall be part of their assessment under Article <br />IX below. <br />SECTION 10. TREE PRUNING GUIDELINES. In general, healthy native trees need <br />very little care beyond occasional deadwood removal and storm damage cleanup. Excessive <br />summer irrigation, trenching, backfill, construction and compaction often stress trees, creating <br />opportunities for disease and insect colonization.
