b. The City only plants new street trees during the trees' dormant period between the <br />months of November through March. <br />c. To get on the list for the City's next planting season, the property owner must contact <br />the office of the Urban Forester at 682 -4800. <br />d. No trees will be planted until after home or building construction, driveways, sidewalks <br />and rough landscaping is completed. <br />e. The property owner may request the planting of any species of tree included in the <br />City's "Approved Street Tree Species list" which will meet the planting standards <br />contained within City of Eugene Administrative Rule R- 7.280. Selection may be limited <br />by availability. <br />f. It is recommended that the landscaping design within the parking/ planting strip allow <br />for future automated irrigation (automatic irrigation systems are not provided by the <br />City). <br />This Section 6 is specifically enforceable by the City, and by Develop until t he ^ ssee i <br />f4med and then 4v the Association. If the Owner does not comply with any requirements of <br />this Section 6, the Deyeleper, � the Association once it i f Fme , may perform such <br />responsibilities and assess the Owner thereof in the same manner as set forth in Article VII of <br />these Conditions and Restrictions. <br />SECTION 7. ADDITIONAL ENVIRONMENTAL PROTECTION PROVISIONS. The <br />Summit has been designed to develop in harmony with, and to take advantage of, natural <br />wetlands, waterways and forested areas existing on the Property and to protect forested areas <br />and wetlands. These areas are restricted from egress and ingress except for maintenance, <br />enhancement or enforcement purposes. <br />Regulated wetlands shall not be altered, nor shall water be diverted to them from new sources, <br />in any way which is a violation of applicable law. Each resident shall avoid allowing any <br />pesticides, herbicides, fertilizers, petroleum -based products or other hazardous or foreign <br />substances to contaminate Parcels A and B. Regulated wetlands are protected by a setback of 20 <br />feet. <br />The Summit contains natural forested areas and wetlands which are protected, for the <br />enjoyment and benefits of the Association, as well as trees, wildlife, birds, shrubs, flora, fauna <br />and natural waterways native to the area. To protect and preserve these amenities, all Owners, <br />for the common good, agree to conform to the following restrictions: <br />Restrictions in a regulated wetland shall be of the following nature: <br />a. Building or erecting any structure, permanent or temporary, in these areas. <br />b. Building "playhouses ", erecting fences, creating compost piles. <br />c. Firewood storage or permanent or temporary storage of any kind. <br />d. Applying, directly or indirectly, pesticides, herbicides, fertilizers, petroleum -based <br />products or any hazardous substances to the land or foliage. <br />4 <br />
