12 -J2 -10 1224 RCVD <br />ARTICLE IV <br />PARCELS A AND B, STREET TREES, TREE RESTRICTIONS, <br />HOME SITES, ADDITIONAL ENVIRONMENTAL PROTECTION <br />PROVISIONS, CONSTRUCTION PRACTICES, LOTS IO AND 11, <br />TREE PRUNING, DRAINAGE, BPA EASEMENT AND <br />CITY AS BENEFICIARY <br />SECTION 1. PURPOSE. The Summit has been designed to develop in harmony with, <br />and to take advantage of, the natural wetlands and forested areas existing on the Property. <br />Parcel A has drainage protection areas which have been established to protect drainage on the <br />Property, the wetlands and some of the forested areas from development or other disturbance, <br />so that their attributes will remain available for the benefit of the residents of The Summit. <br />SECTION 2. PARCELS A AND B. Parcels A and B contain public easements for <br />drainage and/or storage of storm water and includes waterways which meander through The <br />Summit. Parcel B contains a public access easement. Management goals of Parcel A include the <br />maintenance and enhancement of natural, scenic and environmental qualities while maintaining <br />storm water quality and a functional storm water system. Parcel B contains a small population <br />of Aster curtus, a threatened species. Management goals of Parcel B are to protect the Aster <br />curtus; the only maintenance will be to remove any noxious weeds that may compete with the <br />protected species. If <br />increased erosion is occurring, then erosion control measures such as re- vegetation might be <br />necessary. <br />All Lots and all Common Properties which benefit from storm water runoff and drainage to <br />Parcel A shall have a perpetual nonexclusive easement therefore on Parcel A. <br />Parcels A and B are intended to remain as natural buffers. Site management seeks to encourage <br />the establishment of native species of plants and control nonnative, invasive plants. Parcel A <br />shall not be drained other than by the established drainage system, water shall not be diverted <br />from it other than by the established drainage system, water shall not be diverted to it from new <br />sources, and all effort shall be made to avoid allowing any pesticides, herbicides, fertilizers, <br />
