The <br />summit <br />Homeowners Aasoaiadon <br />December 1, 2010 <br />City of Eugene <br />Parks and Open Space Division <br />1820 Roosevelt Boulevard <br />Eugene, OR 97402 -4159 <br />Dear Parks and Open Space: <br />12 -02 -10 1224 RCVD <br />Under the Covenants and Restrictions for The Summit PUD, we are required to notify the City of <br />Eugene before we amend Article IV of those covenants, since the City is a third party beneficiary <br />of that section. The Summit Homeowners Association voted at our 2010 Annual Meeting to <br />amend that section in order to clarify the language. Attached is a copy of Article IV with the <br />amendments highlighted. <br />Since there are no substantive changes, we went ahead and filed the amendments with Lane <br />County. I hope this does not create a problem, since technically we were supposed to get the <br />City's sign -off, first. It is not clear as to which City division we are supposed to notify, so I am <br />guessing (because of the content) that it is Parks and Open Space.
