ACTION UPON FAILURE TO EXECUTE CONTRACT. <br />In the event that a contract can not be negotiated with the highest ranked Offeror, <br />regardless of whether the City evaluates a Short List or selects the highest ranked Offeror <br />based on written proposal evaluations, negotiations will be discontinued, and the City will <br />start contract negotiations with the next highest ranked Offeror. Nothing in this RFP shall <br />restrict or prohibit the City from canceling the solicitation at any time. <br /> <br />D.
