• • <br />INTERGOVERNMENTAL CONTRACT <br />C ®p� <br />BETWEEN: The City of Eugene, a unit of <br />local government of the State of Oregon (City) <br />AND: Lane Transit District, a unit of <br />local government of the State of Oregon (LTD) <br />RECITALS <br />A. ORS 190.010 provides that units of local government may enter into agreements for the <br />performance of any and all functions and activities that any party to the agreement, its <br />officers or agents have the authority to perform. <br />B. Eugene Code Section 6.305 (3) states that no person shall remove a street tree without <br />first obtaining a permit from the city manager specifically authorizing the removal of a <br />street tree. Permit approval may be conditioned upon replacement of the street tree with <br />another tree pre- approved by the city, or a requirement to pay to the city an amount <br />sufficient to fund the planting and establishment by the city of a. tree of similar value. <br />C. City and LTD desire to recognize the planting of trees internal to the Eugene Station <br />Project development site as mitigation for the removal of street trees from the abutting <br />street right -of -way as required by Eugene Code 6.305 (3). <br />D. City and LTD have determined that the public interest is served through the agreements <br />described in this contract. <br />E. City and LTD desire to enter into a contract whereby each will be governed by the <br />agreements described in this contract, the terms and conditions set forth herein and in the <br />following exhibits: <br />Exhibit - A List of Street Trees Removed due to LTD Eugene Station Project <br />Exhibit - B LTD Eugene Station Project Development Plan Including Replacement Trees <br />AGREEMENT <br />LTD AGREES: <br />The trees identified in Exhibit "B" shall be planted, established, and maintained as public <br />assets. <br />2.
