Overview <br />This Street Tree Plan is for the final approval of SILVER ACRES FIRST ADDITION as <br />required in EC 7.280 and Administrative Rule R- 7.280. The fees to plant and establish street <br />trees noted in this agreement have been determined using the Fee Schedule adopted March 18, <br />2004 as Administrative Order No. 58- 04 -03 -F. The scope of the Developer's responsibilities for <br />establishing street trees in this development will be determined according to the policies of the <br />1992 Urban Forest Management Plan, the species selection, spacing, location, planting, <br />establishment, pruning, replacement and protection standards of R- 7.280, and final field <br />conditions at time of tree planting. <br />Developer's Responsibilities <br />Purchase, installation and establishment of the street trees will be the responsibility of the <br />Developer. The Developer has chosen `Option B' of the Street Tree Plan Agreement, as <br />specified in R- 7.280, where the Developer assumes responsibility for the planting and <br />establishment of street trees in the development. Street trees shall be required to be planted in <br />the right -of -way of newly- created streets and existing streets that abut the development after <br />completion of the streets, and the trees shall be installed along the right -of -way adjacent to each <br />lot within the development within six months of occupancy of the residence on the respective lot. <br />Tree species selection must meet the matrix requirements of the Approved Street Tree Species <br />List (attached as an Appendix to R- 7.280) according to soil types, planter widths and overhead <br />restrictions. The Urban Forester may approve substitutions only if the proposed alternate tree is a <br />cultivated variety of a species already on the Approved Street Tree Species List. To meet the <br />species diversification and native species goals contained in the Urban Forest Management Plan <br />Policies 1.0 and 2.0, not more than 30% of all trees planted in the development will be of one <br />species, and not less than 50% of all trees planted in the development will be large canopy shade <br />trees. <br />Care and maintenance of each street tree, as outlined in R- 7.280 -F, Establishment Standards, <br />shall continue for a three year establishment period, beginning on the date the tree is initially <br />installed and written documentation of such is provided to the City. Any dead, stressed or non - <br />approved tree, as defined in R- 7.280 -F(6), Tree Replacement, shall be replaced by the Developer <br />during the next approved planting season after receipt of the notice of the need to replace the tree. <br />The three -year establishment period for replacement trees will begin as above. Once the three - <br />year establishment period has elapsed, the Developer shall notify the city of Eugene, and a final <br />inspection will be performed. The City will accept future responsibility of approved trees in their <br />entirety, and the Developer may at that time request that the bond be released or reduced <br />accordingly. <br />The Developer shall meet all the requirements contained within the contractual Agreement, this <br />Street Tree Plan and as specified in Administrative Rule R -7.80 and all other applicable city <br />codes. <br />Street Tree Plan 4 <br />
