TRADE SERVICES CONTRACT, (Non - Facility) BETWEEN: The City of Eugene, an Oregon Municipal Corporation AND: Lester Brock Construction CONTRACT NO.: 2011 -05306 EFFECTIVE DATE: October 1, 2010 RECITALS (City) (Contractor) A. Contractor is engaged in the business of construction, and has obtained and currently holds all licenses, permits, certifications, bonds or other authorization required by Federal, State or local law or regulations to engage in such business. B. City desires to engage Contractor to perform the services described in the attached Exhibit D (the "Services "). Contractor has represented that it is qualified to perform the Services, and desires to enter into this contract with City on the terms set forth below. AGREEMENT 1. Engagement. City hereby engages Contractor to perform the Services, and Contractor agrees to perform the Services, according to the terms and conditions set forth herein and in the following exhibits: Exhibit A — City of Eugene Standard Contract Provisions Exhibit B — Bid from Contractor Exhibit C — Scope of Services as Bid (the "Work ") 2. Term. The provisions of this contract shall be completed by November 30, 2010, unless earlier terminated in accordance with paragraph 16. 3. Consideration. As consideration for performance of the Services, City shall pay Contractor the sum of $1,000 for each concrete pad poured as bid by the Contractor and described in Exhibit B, plus or minus modifications requested by City and provided by Contractor at the hourly rate bid. Payment shall be made based on invoice by the Contractor and shall be made not later than 30 days after the invoice is received and acceptance of the work by the City of Eugene. 4. Equipment. Contractor shall provide all materials, equipment, supplies or other items required for performance of the Services. Non - Facility Trade Service Contract- -Page 1 (Revised December 1997)
