promotional expenditures; f) executive salaries above the grade of Building <br />manager and superintendent; g) any expenses for which Landlord is compensated <br />through proceeds of insurance or condemnation awards or from any tenant or other <br />occupant of the Building or any expenses incurred by Landlord resulting from fire, <br />casualty or an eminent domain proceeding; h) any rent or additional rent or <br />charges under any lease or sublease made to or assumed by Landlord; i) the cost <br />of special cleaning or other special work or services performed for or furnished to <br />another tenant; j) costs representing amounts paid to companies affiliated with <br />Landlord which costs are in excess of the amount which would have been paid in <br />the absence of such relationships; k) cost of any work performed or service or <br />materials furnished to any facility other than the Building or the real property; 1) all <br />costs incurred in connection with the initial construction of the Building, including the <br />cost of removal of any violations therefrom and the costs of repairing any latent <br />defects in the Building at anytime during the term of the lease; m) all costs incurred <br />in connection with any obligation of Landlord to comply with any judgment, order or <br />decree; n) all costs incurred in connection with any remedial action required in <br />connection with the presence of hazardous materials; o) all cost incurred in <br />connection with.the performance of alterations which are required to comply with <br />any laws, rules or regulations or any government agency: p) all charges for <br />depreciation or amortization of any capital improvements (except as otherwise <br />specifically set forth above and below) or Tenant improvements; q) interest <br />expense or debt service charges related to Landlord financing; r) all costs of capital <br />improvements or capital expenditures of any nature, except that such costs may be <br />included in operating expenses based on the amortization of such expenses over <br />the useful life of the improvement or other item, determined in accordance with <br />generally accepted accounting principles. Tenant shall have the right to review <br />Landlord's operating expense calculations and the supporting documentation within <br />two weeks of Tenant's written notice of its desire to do so and shall have the right to <br />contest any expense which does not seem reasonable by standard real estate <br />accounting practices. <br />4.8 Base Year Expense Limitation. <br />Base year expense amounts have been established at the time of this Lease origination with the <br />knowledge of actual and estimated budget numbers. If during the base year, any budget number <br />should increase greater than ten percent (10%) due to a change in government regulations or <br />commissions, or utility or energy policies, Landlord may elect to allocate these increases on a <br />prorata basis during the same base year. Said expense increases will not alter the original base <br />year expense amounts for the remaining Term of this Lease. <br />Personal Property Taxes. <br />Tenant shall pay, or cause to be paid, before delinquency, any and all taxes levied or assessed <br />during the Term upon all Tenant's leasehold improvements, equipment, furniture, fixtures, and any <br />other personal property located in the Leased Premises. <br />6. Licenses and Taxes. <br />Tenant shall be liable for, and shall pay throughout the Term, all license and excise fees and <br />business and occupation taxes covering the business conducted on the Leased Premises. <br />Lease Agreement - 5 Please Initia <br />ndlord TeT~ <br />
