City of Eugene / State of Oregon - Dept of Transportation <br />Agreement No. 25565, Amendment No. 1 <br />through the corporate limits of Agency, is a designated National Highway System <br />route, subject to federal and state regulations. <br />Exhibit A shall be deleted in its entirety and replaced with the attached Revised <br />Exhibit A. All references to "Exhibit A" shall hereinafter be referred to as <br />"Revised Exhibit A." <br />TERMS OF AGREEMENT, Paragraph 2, Page 2, which reads: <br />2. Under such authority, Agency agrees to construct pavement rehabilitation on High <br />Street from 3rd Avenue to 17th Avenue, hereinafter referred to as "Project". The <br />location of the Project is shown on the sketch map attached hereto, marked "Exhibit <br />A", and by this reference made a part hereof. Because High Street is on the National <br />Highway System (NHS), it continues to be subject to the requirements of 23 United <br />States Code (USC) 131 and the Oregon Motorist Information Act, ORS 377.700 to <br />377.840 and ORS 377.992. State retains authority to enforce those law. <br />Shall be deleted in its entirety and replaced with the following: <br />2. Under such authority, Agency agrees to perform preliminary engineering and <br />construct Agency's High Street from 3~d Avenue to 17th Avenue pavement <br />rehabilitation project. Agency shall also construct avement rehabilitation and minor <br />storm water repairs on Garfield Street: West Wh Avenue to West 11th Avenue; <br />construct pavement overlay in compliance with 1R-Paving Guidelines on Crescent <br />Avenue: North Game Farm Road to Shadow View Drive; and construct pavement <br />overlay on West First Avenue: Seneca Road to Bertelsen Road. Collectively these <br />elements shall hereinafter be referred to as the 2010 Pavement Preservation <br />Program ("Project"). The location of the Project is shown on the sketch maps <br />attached hereto, marked "Revised Exhibit A", and by this reference made a part <br />hereof. Because High Street is on the National Highway System (NHS), it continues <br />to be subject to the requirements of 23 United States Code (USC) 131 and the <br />Oregon Motorist Information Act, ORS 377.700 to 377.840 and ORS 377.992. State <br />retains authority to enforce those laws. <br />TERMS OF AGREEMENT, Paragraph 3, Page 2, which reads: <br />2. The Project shall be conducted as a part of the ARRA Program under Title 23, <br />United States Code. The total Project cost is estimated at $750,000, which is subject <br />to change. ARRA Program funds for this Project shall be limited to $750,000. The <br />Project will be financed with ARRA funds at 100 percent of the maximum allowable <br />federal participating amount. Agency will not be required to provide a match for the <br />ARRA funds but will be responsible for any non-participating costs, including all <br />costs in excess of the available federal funds. No ARRA funded invoices will be <br />accepted and no ARRA funded payments will be made after September 30, 2015. <br />Page 2 of 9 <br />
