Master Certification Agreement No. 24651 <br />AMENDMENT NO. 1 <br />Oregon Department of Transportation <br />LOCAL AGENCY CERTIFICATION PROGRAM <br />American Recovery and Reinvestment Act of 2009 <br />Supplemental Project Agreement No. 25565 <br />2010 Pavement Preservation Program (Garfield Street, High Street, <br />Crescent Avenue and West First Avenue) <br />City of Eugene <br />The STATE OF OREGON, acting by and through its Department of Transportation, <br />hereinafter referred to as "State"; and CITY OF EUGENE, acting by and through its <br />designated officials, hereinafter referred to as "Agency", entered into Local Agency <br />Supplemental Project Agreement No. 25565 on June 2, 2009. Said Agreement covers <br />the construction of pavement rehabilitation on High Street from 3rd Avenue to 17th <br />Avenue. <br />It has now been determined by State and Agency that the Agreement referenced above, <br />shall be amended to correct inconsistencies in the Agreement language, combine the <br />ARRA construction phase and funding of Agency's: 1) Garfield Street: West 6th Avenue <br />to West 11th Avenue project ($719,00); 2) Crescent Avenue: North Game Farm Road to <br />Shadow View Drive project ($305,000); and 3) West First Avenue: Seneca Road to <br />Bertelsen Road project ($998,000), to the ARRA PE and construction phase and <br />funding of Agency's: 4) High Street: 3rd Avenue to 17th Avenue project ($750,000). <br />Collectively these four (4) elements of the project shall be called the 2010 Pavement <br />Preservation Program (Garfield Street, High Street, Crescent Avenue, and West First <br />Avenue) Project. In addition, amend the Agreement to reduce the total ARRA funding by <br />$536,000. The $536,000 will be applied to Agency's 11th Avenue and 13th Avenue Paving <br />ARRA contingency project, Agreement No. 26415. Except as expressly amended below, <br />all other terms and conditions of the Agreement are still in full force and effect. <br />RECITALS, Paragraph 3, Page 1, which reads: <br />3. High Street, routed through the corporate limits of Agency, is a designated National <br />Highway System route, subject to federal and state regulations and is under the <br />jurisdiction and control of the Agency. 3rd Avenue through 17th Avenue are part of <br />the Agency's city street system under the jurisdiction and control of Agency. <br />Shall be deleted in its entirety and replaced with the following: <br />3. Pacific Highway West (OR 99W) is a part of the State highway system under the <br />jurisdiction and control of the Oregon Transportation Commission. Garfield Street, <br />Crescent Avenue, West First Avenue, and High Street are part of the Agency's city <br />street system under the jurisdiction and control of Agency.
