Master Certification Agreement No. 24651 <br />Oregon Department of Transportation <br />LOCAL AGENCY CERTIFICATION PROGRAM <br />American Recovery and Reinvestment Act of 2009 (1 R-Paving) <br />Supplemental Project Agreement No. 26415 <br />West 11th Avenue and West 13th Avenue Pavement Preservation <br />City of Eugene <br />THIS AGREEMENT is made and entered into by and between the STATE OF OREGON, <br />acting by and through its Department of Transportation, hereinafter referred to as "State;" <br />and the CITY OF EUGENE, acting by and through its designated officials, hereinafter <br />referred to as "Agency," hereinafter individually referred to as the "Party," or collectively <br />referred to as the "Parties." <br />RECITALS <br />By the authority granted in Local Agency Certification Program (Certification Program) <br />Agreement No. 24651, incorporated herein and by this reference made a part hereof, <br />State may enter into this Supplemental Project Agreement with Agency for the <br />performance of work on this improvement Project. The Certification Program allows <br />State to certify a Local Agency's procedures and delegates authority to the certified <br />Local Agency to administer federal-aid projects that are not on the National Highway <br />System. <br />2. West 11th Avenue and West 13th Avenue are part of the Agency's city street system <br />under the jurisdiction and control of Agency. <br />3. The Project in this Supplemental Project Agreement is one of the required test <br />projects that constitute conditional certification described in Certification Program <br />Agreement No. 24651. <br />4. The American Recovery and Reinvestment Act of 2009, hereinafter referred to as the <br />"ARRA", provides funding for job preservation and creation, infrastructure investment, <br />energy efficiency and science, assistance to the unemployed, and State and local <br />fiscal stabilization, for fiscal years 2009 and 2010. <br />5. The ARRA provides each state a sub-allocation of ARRA funds for cities, counties <br />and metropolitan areas. <br />6. This Agreement identifies a contingency ARRA project to be performed by Agency. <br />Said contingency project, West 11t Avenue and West 13th Avenue Paving, is made <br />possible through cost savings from Agency's 2010 Pavement Preservation Program <br />(Garfield Street, High Street, Crescent Avenue, West First Avenue) construction <br />project ($536,000); Garfield Street: West 6th Avenue to West 11th Avenue preliminary <br />engineering (PE) phase ($38,000); West First Avenue: Seneca Road to Bertelsen <br />Key No. 16866 <br />
