Eugene Water & Electric Board (EWEB) <br /> <br /> i <br /> AND: The City of Eugene <br /> Water Main Replacement for Elmira Road Reconstruction Project from Bertelsen to <br /> Maple Street <br /> THIS INTERGOVERNMENTAL AGREEMENT, hereinafter referred to as "Agreement" is <br /> made and entered into by and between the Eugene Water & Electric Board hereinafter <br /> referred to as "EWEB," and the City of Eugene hereinafter referred to as "City." The City <br /> and EWEB are herein referred to jointly as the "Parties." <br /> RECITALS <br /> By the authority granted in ORS 190.010, which allows governmental. bodies to enter into <br /> agreements for the performance of any or all functions and activities that the Parties to the <br /> Agreement, their officers, or agents have the authority to perform. <br /> WHEREAS, the City is performing street reconstruction work on Elmira Road between <br /> Bertelsen Road and Maple Street and on Maple Street from Elmira Road to Roosevelt <br /> Boulevard in 2009, (referred to herein as the "Project") which is within City's right-of-way. <br /> The Project typically includes excavating of the existing road, constructing curbs, sidewalks, <br /> storm. drainage conveyance and quality treatment, replacing the road base and repaving <br /> with asphalt concrete. EWEB-has requested the City to stage construction of the Project to <br /> coordinate the storm pipe and an EWEB waterline. This will accommodate EWER work to <br /> construct an 8-inch water main installation and the associated water services, street <br /> crossings; testing and chlorination (referred to herein as the "Work")for the section of Elmira <br /> .Road between station 4+00 to 18+64Ft (approximately Hope Loop to Louis Street) by <br /> EWEB personnel and forces. EWEB will work approximately 50-100 feet behind the <br /> contractor to install the parallel water main. The City's contractor will be responsible for <br /> constructing a joint trench including a bench for the 8-inch water main, backfilling and <br /> compacting the storm pipe zone ahead of the EWEB crew. The Contractor shall also backfill <br /> and compact the waterline trench behind the EWEB crew. In addition to the water main <br /> EWEB will install service laterals where needed to service existing properties from the new <br /> water main. This work will be coordinated with the prime contractor in such a manner as to <br /> not delay the prime contractors work schedule. <br /> The Work excludes other areas on Elmira Road and Maple. Street. At these areas, EWEB <br /> will install all replacement facilities before the City construction improvements begin; <br /> NOW THEREFORE, the Parties have agreed to accomplish that work as follows: <br /> TERMS OF AGREEMENT <br /> The term of this agreement .shall begin upon its execution and continue through the <br /> completion of the work, and there after shall expire. <br /> <br />
