City of Eugene Contract#: 2003-00211 <br /> - INTERGOVERNMENTAL AGREEMENT - <br /> THIS AGREEMENT entered into by and between Lane County, a political <br /> subdivision of the State of Oregon, hereinafter referred to as COUNTY, and the City of <br /> Eugene, a munidpal corporation of the State of Oregon, hereinafter referred to as CITY. <br /> • RE- <br /> . 1. ORS 190.010 and the Lane County.Home Rule Charteruprovide that un~s of <br /> local government may enter into agreements for the pertormance of any and all - <br /> functions and activities that a party to the agreements, its officers or agents, have ~ - <br /> -authority to perform; and <br /> - 2. ORS 373.260(1)(a) •provides that counties and sties may enter into <br /> intergovernmental agreements for the construction, improvement or repair of, and the <br /> • ~ 'acquisition of right-of-way for any county road or city street within the corporate limits of <br /> <br /> . the city; and <br /> 3: Through adoption of its FY 01/02 through FY 05/06 Capital Improvement <br /> Program, the Lane County Board of Commissioners has approved funds for asphalt <br /> overlay maintenance within the County road network. . <br /> 4. In 2002, CITY will be oonstnicting improvements (refer-ed to herein-as the <br /> `Project") to a portion of River Road, which is within CtTY's jurisdiction: The Project will , ' <br /> :.indude resurtadng of the existing road with an asphalt overlay. COUNTY has requested <br /> CITY to expand the Project to indude the resurtadng of an adjacent segment of giver <br /> Road within COUNTY's jurisdiction (from the intersection of Maxwell Avenue, North, to <br /> the intersection of Coriiss Avenue, approximately 115U feet) with a two-inch inlay of the . <br /> Crave! lanes and a two-inch (2") asphalt overlay. The work wilt indude related pavement <br /> markings and traffic signal loop detecfion wiring. " <br /> ' AGREEMENTS <br /> CITY AGREES TO: <br /> . <br /> • 1. Perform asphalt overlay work"for COUNTY as spedfied and administer <br /> overlaycontract. - - . <br /> 2.
