4.2 The District shall reimburse the City for all eligible costs of the Project, and the <br /> - full costs of any Additional District Work, as provided in Section 5. <br /> 4.3 The District shall request the School Boazd to increase the District funding <br /> amount for the Project to more than $301,000 if the City estimates that the District's. obligation <br /> for reimbursement with respect to the Project will exceed that amount. <br /> ~i 4.4 The District shall permit the City's agents and employees to have entry over and <br /> upon District-owned property as necessary to conduct surveys, tests and other studies necessary <br /> ~ for the Project, Additional City Work and Additional District Work. <br /> 4.5 The District agrees to provide such temporary easements as aze reasonably <br /> requested by the City to enable construction activities to be conducted in a safe and expedient <br /> ~ manner. <br /> SECTION 5. Payment of Project Ezpenses. <br /> 5.1 Project Costs Defined. The Project Cost for which the District will be obligated <br /> hereunder include all of the types of costs described in Eugene Code ("EC") Section 7.170(1) but <br /> <br /> ' not the costs that would benon-assessable by the City as described in EC § 7.175(1). - <br /> 5.2 Pre-Construction Costs and Additional District Work. District agrees that its <br /> obligation to reimburse the City for the following costs and expenses shall beunconditional: - <br /> 5.1.1 All costs of engineering and the production of construction documents for <br /> the Project, including, but not limited to, all tests, surveys, preliminary soils tests, <br /> engineering fees and administrative expenses; <br /> 5.,1.2 All costs of the solicitation of bids and proposals for the construction of <br /> - the Project; and <br /> 5.1.3 All costs of any authorized Additional District Work. <br /> S.2 Pro, <br /> ject Construction Costs. District's obligation to reimburse the City for costs <br /> and expenses in addition to those described in Subsection 5.1 shall be subject to the conditions <br /> described below: <br /> 5.2.1 Within seven (7) days after the opening of bids for Project construction, <br /> and prior to the commencement of construction, the City will deliver to the District an <br /> estimate of the Project Cost, including all costs described in Subsection 5.1.1 and 5.1.2. <br /> 5.2.2 - If the estimated Project Cost does not exceed $301,000, the City shall - <br /> - proceed with construction and the District shall be unconditionally obligated to reimburse <br /> the City for the actual Project Cost up to a total sum of $301,000. <br /> i <br /> Intergovernmental Agreement - 3 <br /> <br />
