City of Eugene Contract#:2002-00244 Intergovernmental Agreement i For WII.L-HI STREET IlViPROVEMENTS THIS INTERGOVERNMENTAL AGREEMENT (this "Agreement") is made as of the 2 day of Apri 1 , 2002 between the Bethel School District ("District") and the City of Eugene, ("Eugene"), each parry being a unit of local government. RECITALS 1. The District's property abuts the northern edge of all of that portion of the public ~ right of way for Will-Hi Street existing east of Echo Hollow Road (the "Street") within the City of Eugene, Oregon. I~ - 2. - The southern portion of the public right of way for the Street is comprised of a thufiy foot vv~de sinp dedicated as a public way by Echo Hollow Pazk and the Echo Hollow Park 1 Addition. The northern portion of the public right of way for the Street is a thirty-foot-wide strip dedicated as a public way by the District. 3. The Street is currently improved as acounty-standard asphalt mat street with ' ditches. 4. The District wishes the Street to be improved to comply with City standards for ublic streets, and is willin to a for all costs of the Project that would normally be assessed P g PY J against benefited property if the project were undertaken as a local improvement project under the conditions set forth herein. 5. The District boazd of directors passed resolution number 57 on January 14', 2002 eein to a 100% of the landowner costs associated with the Willhi Street im rovements by a8Y' g P Y P the City of Eugene. 6. The City has agreed to design, construct and administer the Project, as provided herein. 7. The District has requested that the City schedule construction activities with the goal of completing the Project prior to the commencement of the 2003 school yeaz. 8. ORS 190.010 authorizes units of government to enter into agreements for the joint performance of any or a11~ functions and activities that either parry to the agreement has the authority to perform. .
