City of Eugene Contract#:2002-00244 <br /> Intergovernmental Agreement <br /> i For <br /> WII.L-HI STREET IlViPROVEMENTS <br /> THIS INTERGOVERNMENTAL AGREEMENT (this "Agreement") is made as of <br /> the 2 day of Apri 1 , 2002 between the Bethel School District ("District") and <br /> the City of Eugene, ("Eugene"), each parry being a unit of local government. <br /> RECITALS <br /> 1. The District's property abuts the northern edge of all of that portion of the public <br /> ~ right of way for Will-Hi Street existing east of Echo Hollow Road (the "Street") within the City <br /> of Eugene, Oregon. <br /> I~ - 2. - The southern portion of the public right of way for the Street is comprised of a <br /> thufiy foot vv~de sinp dedicated as a public way by Echo Hollow Pazk and the Echo Hollow Park <br /> 1 Addition. The northern portion of the public right of way for the Street is a thirty-foot-wide <br /> strip dedicated as a public way by the District. <br /> 3. The Street is currently improved as acounty-standard asphalt mat street with <br /> <br /> ' ditches. <br /> 4. The District wishes the Street to be improved to comply with City standards for <br /> ublic streets, and is willin to a for all costs of the Project that would normally be assessed <br /> P g PY J <br /> against benefited property if the project were undertaken as a local improvement project under <br /> the conditions set forth herein. <br /> 5. The District boazd of directors passed resolution number 57 on January 14', 2002 <br /> eein to a 100% of the landowner costs associated with the Willhi Street im rovements by <br /> a8Y' g P Y P <br /> the City of Eugene. <br /> 6. The City has agreed to design, construct and administer the Project, as provided <br /> herein. <br /> 7. The District has requested that the City schedule construction activities with the <br /> goal of completing the Project prior to the commencement of the 2003 school yeaz. <br /> 8. ORS 190.010 authorizes units of government to enter into agreements for the joint <br /> performance of any or a11~ functions and activities that either parry to the agreement has the <br /> authority to perform. . <br /> Intergovernmental Agreement - 1 <br /> <br />
