ADMINISTRATIVE ORDER N0.58-02-24 ~ ~`~` [~( <br />~ `, ~ ~ ' <br />of the ~ <br />City Manager pro tem of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF <br />WETLANDS MITIGATION BANK FEE. <br />The City Manager pro tem of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. <br />B. The City has an agreement with the Oregon Division of State Lands (ODSL) and U.S. <br />Army Corps of Engineers to restore and create wetlands to satisfy mitigation obligations for <br />development within the City. <br />C. The City has been charging $30,000 per acre for mitigation wetlands in order to <br />recover its costs of developing and maintaining those wetlands. Although the City's' costs of <br />developing and maintaining those wetlands has increased, this charge has remained the same for over <br />seven years. <br />D. Based on an evaluation of those increased costs, staff has recommended that the fee <br />be increased to $50,000 per acre. I concur with that recommendation, and intend to amend the <br />wetlands mitigation fee as set forth in the Notice of Intended Fees attached as Exhibit A hereto and <br />incorporated herein by reference. <br />E. I find that. the proposed fee set forth in Exhibit A hereto is consistent with applicable <br />policies and directives of the City Council to recover the cost of services from the direct beneficiaries <br />of those services, has been computed in a manner consistent with the requirements of the City's <br />agreement with ODSL and the U.S. Army Corps of Engineers, and is necessary in order to defray <br />the costs associated with the wetland mitigation program. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, posted at two <br />locations at City Hall, published in the Register Guard, a newspaper of general circulation within the <br />City, and be made available for inspection by interested persons at the office of the City Manager, <br />City Hall, 777 Pearl Street, Eugene, Oregon 97401. <br />2. All persons desiring to comment thereon shall submit written comments as set forth <br />in the Notice.
