~•,. <br />ADMINISTRATIVE ORDER N0.58-02-24-F <br />of the <br />City Manager pro tem of the City of Eugene <br />AMENDMENT OF WETLANDS MITIGATION BANK FEE. <br />The City Manager pro tem of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal properly, <br />and licenses and permits. <br />B. In accordance with the procedures set forth therein, on August 22, 2002, I issued <br />Administrative Order No. 58-02-24 and notified the Mayor and City Councilors that I intended to <br />increase the wetlands mitigation bank fee in order to recover the costs of developing and maintaining <br />the wetlands in accordance with the agreement that the City has with the Oregon Division of State <br />„f Lands (ODSL) and U. S. Army Corps of Engineers to restore and create wetlands to satisfy mitigation <br />obligations for development within the City. <br />C. Notice was also posted at two locations at City Hall and published in the Register <br />Guard, a newspaper of general circulation within the City, on August 23, 2002, and made available <br />for inspection by interested persons at the office of the City Manager, City Hall, 777 Pearl Street, <br />Eugene, Oregon 97401. Notice provided that written comments would be received for a period of <br />15 days from the date of posting and publication. No written comments were received within the <br />time or in the manner provided in the Notice. <br />D. Based upon these findings and the findings set forth in Administrative Order No. 58- <br />02-24, Ifind that the Wetlands Mitigation Bank fee of $50,000 per acre is consistent with applicable <br />policies and directives of the City Council to recover the cost of services from the direct beneficiaries <br />of those services, has been computed in a manner consistent with the requirements of the City's <br />agreement with ODSL and the U.S. Army Corps of Engineers, and is necessary in order to defray <br />the costs associated with the wetland mitigation program. <br />On the basis of these findings, I order that: <br />The Wetlands Mitigation Bank fee to be charged as of the effective date of this Order is <br />$50,000 per acre. <br />Dated anal effective this G`in'' day of September, 2002. <br />-, <br />ames R. arlson <br />City Manager pro tem <br />Administrative Order <br />C:\TEMP\02wet1andmit2ao.wpd <br />
