NOTICE OF INTENDED AMENDMENT OF <br />.UTILITY RIGHT-OF-WAY USE PERMITS FEES <br />To: The Mayor and City Councilors of the City of Eugene, and other interested persons. <br />NOTICE IS HEREBY GIVEN that pursuant to the provisions of Sections 2.020 and 7.300 <br />of the Eugene, Code, 1971, the City Manager pro tem of the City of Eugene intends to amend the <br />fees for Utility Right-of-Way Use Permits, to add a new section entitled "Major Aerial Installation <br />Permit Fee," as follows: <br />UTILITY RIGHT-OF-WAY USE PERMIT FEES <br />(Effective upon signature of fmal Administrative Order) <br />Current Fee Proposed Fee <br />HI Major Aerial Installation Permit Fee: None See below <br />If the activity to be permitted on an individual permit involves a primarily aerial installation <br />only and exceeds 26,400 feet (5.0 miles), the permit fee shall be computed in two steps, as follows: <br />Step One. The initial 26,400 feet (5.0 miles) shall be permitted under the existing site <br />specific permit fee contained in Section II. <br />Step Two. All additional footage over 26,400 feet (5.0 miles) shall be computed at the rate <br />of $ 0.10 cents per foot. This rate shall be applicable for the calendar years of 2002 and 2003. <br />Primarily aerial installations only that are less than 26,400 feet and not specifically authorized under <br />a blanket permit remain subject to the site specific permit fees of Section II of this schedule. <br />For purposes of this section, "primarily aerial installation" is the installation of wire or cable <br />type facilities on existing poles or approved above-ground structures. The installation or <br />replacement of pole anchors may be approved as part of an aerial installation permit as long as the <br />installation is completed within a radius of 10 feet from the existing pole or structure. Other <br />ancillary equipment and underground facilities shall not be considered aerial components under this <br />Schedule and as such shall require a separate site specific permit under Section II of this Schedule. <br />In addition to these requirements, all aerial activities shall comply with the standards contained <br />within the Utility and Right-of--Way Permits Construction Within and Use of the Public Way <br />Policies and Procedures Manual, and other applicable documents. <br />The fee as proposed above is intended to provide an equitable fee for major activities that <br />Notice - Exhibit A - 1 <br />r:~adminord~fees102utilrownot.wpd(09/16/02) <br />
