ADMINISTRATIVE ORDER NO. 58-03-09-F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT TO THE WASTEWATER USER FEE <br />SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER <br />N0.58-02-17-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971, <br />authorizes the City Manager to determine and set fees and charges to be imposed by the <br />City for wastewater service, regional wastewater service, and stormwater service. <br />B. In accordance with the procedures set forth therein, on June 27, 2003, I <br />issued Administrative Order No. 58-03-09, and notified the Mayor and City Councilors that I <br />intended to increase the Wastewater User Fee Schedule established by Administrative <br />Order No. 58-02-17-F on June 20, 2002, as set forth in the Notice attached thereto, <br />effective for all bills issued on or after August 1, 2003. <br />C. Notice was also provided to the news media, any person who had requested <br />__ notice, and to interested governmental agencies (including the United States <br />Environmental Protection Agency, the Department of Environmental Quality, MWMC, and <br />the Eugene Water & Electric Board). In addition, the Notice was posted at two locations at <br />City Hall on July 1, 2003, and published on two separate occasions in the Register-Guard, <br />a newspaper of general circulation within the City, on July 1 and 8, 2003. The Notice was <br />made available for inspection by interested persons at the offices of the Public Works <br />Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal business hours <br />(8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br />D. The Notice provided that written comments would be received for a period of <br />10 days from the first date of publication and posting, or at the public hearing to beheld in <br />the Public Works Department, 858 Pearl Street, Eugene, Oregon, 97401, on Juty 14, 2003, <br />between noon and 1:00 p.m.. No written comments were received at the public hearing or <br />within the time or in the manner required by the Notice. <br />E. Pursuant to subsection (1) of Section 6.411 of the Eugene Code, 1971, I <br />have conducted an investigation of the revenue needs of the City in providing these <br />services and have reviewed the .recommendation of the Metropolitan Wastewater <br />Management Commission (MWMC). <br />F. Based on my investigation and MWMC's recommendation, and the findings <br />set forth herein, I find that the proposed Wastewater User Fee Schedule is in compliance <br />with the Council's directive that the costs of providing such services be recovered from the <br />Administrative Order -Page 1 <br />
