The permittee shall exercise care to avoid disturbing or destroying survey monuments. Survey <br />monuments disturbed by the permittee's work shall be restored in conformance with requirements <br />of ORS 209.150. <br />3.J.1 Damage to City Facilities. <br />If apermittee's failure to complywith OAR 952-001-0010 through 952-001-0090 or failure to use <br />reasonable care to protect City facilities causes damage to a City facility, the permittee shall be <br />responsible for all costs of repair or restoration of the facility. When a City facility is damaged the <br />permittee shall immediately notify the Inspector. The Inspector shall submit a damage report and <br />a subsequent repair inspection report to the Traffic Technical Team Supervisor. To aid in the <br />updating of the infrastructure condition records, the damage repair report shall include a measured <br />location and description of the damage and repair. <br />If a permittee contests responsibility for the damage to a City facility discovered within the <br />permittee's work zone, the permittee shall still be held responsible for effecting immediate repairs <br />to the damaged facility. The permittee should then be directed to submit a billing to the Traffic <br />Technical Team Supervisor showing the exact time and materials expended to effect the repairs. <br />Also, the permittee should include, in narrative form, an explanation as to the cause of the damage, <br />the reasons the permittee should not be held responsible, and justification for the billing. <br />' Damage to Wastewater Collection System.- If the damaged facility is a privately owned <br />building wastewater line, the repairs shall be performed by a contractor, plumber, utility <br />crew, or others qualified to perform such work. The work shall be performed in accordance <br />with the State of Oregon Plumbing Specialty Code (UPC) and inspected by the Wastewater <br />Inspector prior to backfill. <br />All "taps" into City Wastewater Collection System mains shall be performed by the City. <br />When the damaged facility is a publicly owned wastewater line, the Wastewater Collections <br />Crew Supervisor shall be immediately notified. The Crew Supervisor shall have the option <br />of providing repairs consultation to the permittee responsible for the damage, directing the <br />repair performed by the person(s) responsible for the damage, or having the repair performed <br />by City crews at the expense of the permittee responsible for the damage. The Inspector shall <br />submit a damage and inspection report to the Traffic Technical Team Supervisor who shall <br />review and approve a billing submittal to the permittee responsible for repair costs incurred <br />by the City. <br />Damage to Stormwater System Components - If the damaged facility is a stormwater <br />pipe, the repairs shall be performed by a contractor, plumber, utility crew, or others qualified <br />to perform such work.
