ADMINISTRATIVE ORDER N0.58-04-02 <br />of the <br />City Manager of the City of Eugene <br />PROPOSED AMENDMENT OF STREET TREE PROGRAM <br />ADMINISTRATIVE RULE R-7.280 <br />The City Manager of the City of Eugene finds that: <br />A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt <br />rules for implementation of any provisions of that Code. Section 7.280 of that Code specifically <br />authorizes the City Manager to adopt rules that establish standards and specifications for <br />implementing the City's Street Tree Program. <br />B. In accordance with the procedures set forth therein, on February 28, 1997, <br />Administrative Order No. 58-96-23-F was issued adopting Street Tree Program Administrative <br />Rule R-7.280, ensuring that the City's Street Tree Program was implemented in compliance with <br />provisions of the Eugene Code, 1971. <br />C. Staff has recommended revisions to Rule R-7.280 that: (a) effect clerical and <br />readability corrections to some of its provisions; (b) clarify language concerning the tree cost <br />calculations; and (c) effect revisions that ensure compliance with newly adopted or amended <br />provisions of the Eugene Code, 1971. <br />D. I concur with staff's recommendations and find that the proposed revisions to the <br />Street Tree Program Administrative Rule R-7.280 are necessary in order to ensure that the <br />Program is implemented in a manner consistent with provisions of the Eugene Code, 1971 and <br />directives of the City Council. <br />Therefore, based on the above findings, I propose to amend Street Tree Program <br />Administrative Rule R-7.280 to provide as follows: ~ <br />STREET TREE PROGRAM <br />ADMINISTRATIVE RULE R-7.280 <br />R-7.280-A Street Tree Program -Policy. <br />In order to create attractive and healthy neighborhood environments, no approvalshall be <br />granted for a development that involves the creation of a street unless the applicant has submitted <br />and received approval of a Street Tree Plan pursuant to R-7.280-C.1 or executed an agreement <br />with the City pursuant to R-7.280-C.2 that ensures street trees will be planted and established in <br />accordance with the standards and procedures provided for in these rules and the adopted <br />policies of the Urban Forest Management Plan. Street trees shall be planted as each lot or area is <br />developed and shall be required on that portion of street right-of--way that abut lots within the <br />development as well as on new streets within the development site. <br />Administrative Order - i <br />
