ADMINISTRATIVE ORDER NO. 58-04-16-F <br />of the <br />AIRPORT MANAGER <br />AMENDMENT OF SECTIONS 4 AND 5 OF THE AIRPORT FEE <br />SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER NOS. <br />58-04-O1-F AND 58-04-10-F. <br />The Airport Manager of the City of Eugene finds as follows: <br />A. Authority is granted to the City Manager of the City of Eugene under Sections 2.440 <br />to 2.442 of the Eugene Code, 1971 to set fees and charges for the use of the Eugene Airport. The <br />City Manager has further delegated that authority to the Airport Manager under Airport Rule 8.4.2. <br />B. Pursuant to that delegated authority, on August 2, 2004, I issued Administrative Order <br />No. 58-04-16, and notified the Mayor and City Council that I intended to amend the Airport Fee <br />Schedule established by Administrative Order No. 58-04-41-F on February 12, 2Q04, and <br />subsequently amended by Administrative Order No. 58-04-10-F on April 16, 2004, asset forth in the <br />Notice attached as Exhibit A thereto <br />C. Notice was also posted at two locations at the Airport and published in the Register <br />Guard, a newspaper of general circulation within the City, on August 2, 2004, provided to persons <br />who had requested notice, persons who are currently paying such charges, and was made available <br />for inspection by interested persons at the offices of the Airport Manager, 28855 Lockheed Drive, <br />Eugene, Oregon 97402 during normal business hours (8:00 a.m. to 5:00 g.m., Monday through <br />Friday, exclusive of holidays). <br />' D. Notice provided that written comments would be received for 15 days from the date <br />of posting and publication. No comments were received within the time or in the manner described <br />in the Notice. <br />E. Based upon the above findings and the findings in Administrative OrderNo. 58-04-16, <br />and after investigating the amoum charged for such use in the past; comparable amounts or rates <br />charged by other airports; the amounts or rates and other municipal benefits agreed to by comparable <br />users of the airport in a contract, lease, or permit; and, the revenue needs of the airport, I have <br />determined that the Airport Fee Schedule should be amended as proposed. As of the effective date <br />of this Order, the fees set forth in Exhibit A attached hereto, should be established. <br />Administrative Order -Page 1 <br />
