ADMINISTRATIVE ORDER NO. 58-99-16 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF THE CITY OF EUGENE'S <br />SYSTEMS DEVELOPMENT CHARGE (SDC) METHODOLOGY AND METROPOLITAN <br />WASTEWATER MANAGEMENT COMMISSION (MWMC) REGIONAL WASTEWATER <br />SDC FEES AND CREDITS <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager of <br />the City of Eugene to determine and set fees and charges to be imposed by the City <br />for services, goods, use of municipal property, and licenses and permits, and <br />specifically systems development charges. Section 7.710 of the Eugene Code, 1971 <br />further authorizes the City Manager to adopt and/or amend by administrative order, <br />the methodologies used for establishing the systems development charges, and <br />provides this may be effected concurrent with the establishment or revision of a <br />systems development charge. <br />B. In accordance with the procedures set forth therein, 1 intend to amend the City of <br />Eugene SDC methodology by: <br />1. Revising the local wastewater SDC; and <br />2. Reflecting a 7.3% fee increase for local transportation, stormwater, and parks SDCs <br />based on the City Engineer's review of the National Construction Cost Index, <br />published by the Engineering New-Record for the preceding twenty-four months, <br />which are adjusted periodically pursuant to Section 2.3 of the July 1, 1998 SDC <br />Methodology and have been included herein for ease of reference only; and <br />3. Revising the regional Metropolitan Wastewater Management Commission (MWMC) <br />wastewater SDC fees and credits, as calculated by MWMC; <br />as set forth in the Notice of Intended Amendment of Systems Development Charge Methodology, <br />Fees, and Credits attached as Exhibit A and incorporated herein by reference, including the <br />attachment thereto. <br />C. I find that the revisions to the Methodology and the fees as set forth in Exhibit A <br />.including the Attachment thereto are consistent with adopted policies and ordinances of <br />.the City, in conformity with applicable state law, and should be implemented effective <br />September 15, 1999. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, published in the <br />Register Guard, a newspaper of general circulation within the City, posted at four public <br />- locations, and copies of the Proposed Changes to Systems Development Charge <br />Methodology be made available for interested persons at the City Managers Office, 777 <br />Pearl Street, Room 105, the Public-Works Lobby, 858 Pearl Street, the Permit & <br />Administrative Order No. 58-99-16 Page 1 of 2 <br />
