ADMINISTRATIVE ORDER N0.58-99-16-F <br />of the <br />City Manager of the City of Eugene <br />,,: <br />AMENDING THE SYSTEMS DEVELOPMENT CHARGE (SDC) <br />METHODOLOGY AND MWMC REGIONAL WASTEWATER <br />SDC FEES AND CREDITS <br />The,City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.705 of the .Eugene, Code, 1971 authorize the City Manager of the <br />City of Eugene to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, and licenses and permits, and specifically systems development <br />charges. Section 7.710 of the Eugene Code, 1971 further authorizes the City Manager to adopt <br />and/or amend by administrative order, the methodologies used for establishing the systems <br />development charges, and provides this may be effected concurren# with the establishment or <br />revision of a systems development charge. <br />B. In accordance with the procedures set forth therein, on July 1, 1999, I notified <br />the Mayor and City Councilors that 1 intended to amend the City of Eugene SDC Methodology by <br />revising the local wastewater SDC; increasing the local transportation, stormwater, and parks SDCs <br />by a 7.3% inflationary adjustment; and revising the regional Metropolitan Wastewater Management <br />Commission (MWMC) wastewater SDC fees and credits, as calculated by MWMC. <br />C. The Notice was also posted on July 2, 1999, in four public places with the City and <br />published on July 4, 1999, in the Register Guard, a newspaper of general circulation within the City. <br />The Notice provided that written comments could be submitted thereon for a period of 30 days, <br />--'through August 3, 1999. Relatively few comments were received for which 1 make the following <br />findings: <br />Comments on revision to the regional (MWMC) wastewater SDC: Concerning the regional <br />wastewater SDC rate table, the medical office description should be moved from category 82 to <br />category 65. In addition, the car wash description category should be 6B, and not 64 as listed. <br />Findings: The medical office description will be listed within category 65 and the <br />carwash category will be changed to 66. <br />~C~imment on revision to the local wastewater SDC: Concerning Table 4A (Plumbing <br />Fixture Unit Rate Table,) provide clarification that a rate per PFU may also be assigned by the <br />City Engineer should a proposed use not be represented by one of the published SDC Use <br />Codes and for which the default flow assignment is not appropriate. <br />Finding: This clarification shall be made by inclusion of a statement at the bottom of <br />the table. <br />Comment on revision to the local wastewater SDC: Provide a list of which local land <br />use codes are assigned to each SDC Use Code. <br />Finding: A separate table with this information will be added to the methodology. <br />Comment on revision to the local wastewater SDC: State that in the case of those <br />proposed developments that are pre-de#ermined to have potential for exceptional water <br />Administrative Order No.58-99-16-F Page 1 oft <br />
