Comment 3. <br />The Sewer User Fee should be considered as a tax, as the City <br />requires connection to the system. <br />Finding• <br />The City Council has classified the Sewer User Fees as not being a <br />tax on property or the ownership of property. This classification <br />was not appealed in a timely manner to the Tax Court. <br />D. Having fully responded to the comments received, I find that the <br />Sewer User Fees set forth in Exhibit A attached hereto and incorporated herein <br />by reference are in compliance with the Council's directive that the costs of <br />providing such services be recovered from the beneficiaries of the services, <br />and with other applicable policies and directives of the Council; are consis- <br />tent with applicable federal and state regulations and the recommendations of <br />the Wastewater Management Commission; are comparable to amounts charged by the <br />City of Springfield and other such service providers; will preserve equity <br />between different classes of ratepayers; and are based on the proposed budget <br />of the City of Eugene and the adopted budget of the Metropolitan Wastewater <br />Management Commission. <br />On the basis of these findings I order that: <br />The monthly sewer user rates for the fiscal year beginning July 1, 1993, and <br />ending June 30, 1994, as set forth in Exhibit A attached hereto and incorpo- <br />rated by reference are hereby approved and adopted. <br />Dated this 14th day of May, 1993 <br />-~ ,~ ,~ <br />Miche 1 D.
