ADMINISTRATIVE ORDER N0. 58-93-06 <br />of the City of Eugene <br />ESTABLISHING SEWER USER RATES <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 7.020 of the Eugene Code, 1971, authorizes the City Manager <br />after notice and public hearing to determine and set fees and charges to be <br />imposed by the City for sanitary sewer service, storm sewer service, regional <br />sanitary sewer service and septage haulers. <br />B. In accordance with the procedures set forth therein, on April 26, <br />1993, I notified the Mayor and City Council that I intended to revise these <br />sewer user rates. Notice of the proposed rates and the date of the public <br />hearing thereon was. posted at two locations at City Hall on April 26, 1993, <br />and published in the Register-Guard on April 26 and May 2, 1993. The Notice <br />provided that written comments would be received thereon at the public hearing <br />and for a period of 15 days from the first date of posting and publication. <br />C. The written comments received in response to the April notice, the <br />issues raised therein, and my findings in response thereto are as follows: <br />Comment 1. <br />A sewer rate increase of 28% is far above the corresponding <br />increase in the cost of living (at approximately 4%) and is <br />completely out of line. <br />Finding• <br />The proposed increase in the combined Sewer User Fee is approxi- <br />mately 7%, although the increase in the portion of the rates <br />supporting the City's sanitary sewer collection system will <br />increase by about 28% when taken alone. This increase is due to <br />recent changes in federal and state permits that require the City <br />to reduce inflow and infiltration. The increased fees are neces- <br />sary to recover the cost of expanding the City's programs to <br />correct inflow and infiltration. <br />Comment 2. <br />It is unfair for the City to charge in-City residents more in <br />Sewer User Fees than users outside the City. <br />Finding• <br />The Sewer User Fee for in-City residents includes a charge for the <br />City's stormwater management program. The City does not provide <br />stormwater services outside the City, so rates for users outside <br />the City are lower.. The rate for sanitary sewer service is the <br />same for all system users, both inside and outside the City. <br />
