_ CITY OF EUGENE <br />INTER-DEPARTMENTAL MEMOI~,ANDUM <br />CITY ATTORNEY -CIVIL DEPARTMENT <br />To: Johnny Medlin -Public Works Date: September 17, 1993 <br />Subject: Tree Preservation Administrative Orders <br />Attached you will find redrafts of: the Administrative Order adopting Temporary <br />Tree Preservation Administrative Rule R-6.305 that incorporates the revisions requested in <br />your memo of August 27, 1993 as we discussed in recent telephone conversations; a Notice <br />of Intended Rulemaking; Administrative Order and Notice of Intended Tree Preservation <br />Fees; and Administrative Order delegating the City Manager's authority to act on his behalf <br />in connection with provisions of the Eugene Code, 1971 relating to tree preservation and' <br />those regulating the industrial pretreatment program to the Public Works Director. <br />If these appear satisfactory, you will need to secure numbers for each of the orders <br />from the City Recorder's office prior to presenting them to the City Manager for signature. <br />After they have been signed and dated, the originals are to he delivered to the City <br />Recorder's office for filing. <br />The Temporary Rule will become effective on the date it is signed, and remain in <br />effect for a period of 180 days unless adopted as a permanent rule prior to its expiration. <br />We have drafted and enclosed the Notice of Intended Rulemaking so that you can initiate <br />action to adopt this as a permanent rule right away if you choose to do so by publishing the <br />notice for five consecutive days in the Register Guard.~fIf you elect to wait, you want to be <br />sure and start the process in sufficient time to be able to adopt a final order before the <br />expiration of the temporary rule. <br />With respect to the fee order, only the Notice attached as Exhibit A needs to be <br />posted, published, and provided to the Mayor and City Councilors. If you coordinate those <br />actions to all occur on the same date, the comment period will be the same for each.
