MEMORANDUM <br />Date: November 1, 1994 <br />From: Les Lyle ~~ <br />} ~~~ <br />To: Chris Anders~n, Mike Gleason <br />Subject: Emergency Administrative Order <br />Attached is an administrative order that we need to execute today. Over the past few <br />weeks we have been implementing the stormwater rate adjustments in response to <br />Council action in September, 1994. One issue that we could not resolve prior to <br />implementation November 1, 1994 was how to handle those accounts with <br />exemptions. At present there are a limited. number of customers that have full <br />exemptions for properties that do not discharge directly or indirectly to the public <br />w~ystem or have containment systems on-site. The exemptions have been focused ~on <br />the water quality and quantity elements since the road element did not exist. An <br />example of an exemption is Downtown Mini-Storage. They drain their si#e into a <br />series of~dry-wells and based on the adopted methodology are fully exempt from the <br />user fee. They have approximately 300,000 sf of impervious area and based on the <br />road element of the user fee ($0.70/1000sf), they would now be expected to pay $240 <br />per month. Again, their area .limited number of commercial/industrial sites that have <br />full exemptions. There are also a limited number of residential customers with full <br />-exemptions and they would begin #o pay a Small charge. <br />A greater .number of customers have reductions such as a portiori of the parking lot at <br />Valley River Center that:drains to the Willarnefte. That area is not included in the <br />current. calculation -of rates but under the new road rate structure that area would now <br />pay $0.70 per 1000sf with the balance of the impervious area paying an increase of <br />$0.30 per 1000 sf. Other public sates would. now be charged for the road share such <br />as the impervious area for the .bike path system. along the river, 4J and Mari,t school <br />sites; etc. These accounts will be adjusted with the November billings to reflect the <br />change in status of the impervious areas. <br />a- <br />Since the methodology document is silent on how to handle the road element, f have <br />concluded that the intent of the Council. was not to provide reductions and exemptions <br />for that portion of the rate for any customer. We are proposing to not collect the fee <br />for those properties that are exempt now` but will fet it accrue over the next two months <br />while we modify the methodology document. At that time we will send a bill for the <br />accrued amount along with that current months billing. Taking this approach will also <br />be consistent with any new measure 5 requirements if it should pass. Modifying the <br />methodology document will follow procedures as outlined in the administrative order. <br />Hope this all makes sense and we can execute this order #oday. If you have <br />
