ADMINISTRATIVE ORDER NO. ~f', - ~y-a 7 <br />.~' of the <br />City Manager of the City of Eugene <br />EMERGENCY RULE CLARIFYING REDUCTIONS AND EXEMPTIONS TO <br />MONTHLY STORMWATER CUSTOMER CHARGES. <br />The City Manager of the City of Eugene finds that: <br />A. On September 28, 1994, Ordinance No. 19984 was passed by the City Council <br />and approved by the Mayor .adopting changes to the monthly stormwater customer charges, <br />separating out components related to roads. <br />B. As amended by Ordinance No. 19984; the monthly stormwater customer charge <br />is now composed of (1) a water quality and quantity component; (2) an administrative <br />component; and (3) a road component. It was intended that reductions and exemptions continue <br />to be available for water quality and quantity components for property, but not for the road <br />component. <br />C. The rate methodology set forth in Exhibit A to Ordinance No. 19984, which <br />provides for complete reductions or exemptions, therefore should be amended to clarify that <br />exemption applies to water quality and quantity components, but not to the road or administrative <br />component. <br />D. The new fees and revisions established by Ordinance No. 19984 go into effect <br />November 1, 1994. That Ordinance, and Sections 6.411 and 6.451 of the Eugene Code, 1971 <br />authorize the City Manager to establish future adjustments to the stormwater customer charges. <br />and adopt such rules, regulations, and methodologies as deemed necessary by the City Manager, <br />following the procedures set forth in Section 2.019 of the Eugene Code, 1971.. <br />E. Pursuant to section 2.019, the City Manager intends to follow formal rule making <br />procedures, including a notice and comment period with respect to longer term changes to the <br />stormwater rate methodology that more accurately reflects the Council's action. In order to <br />ensure the Council's November 1 imposition of the new fee structure is accurately carried out, <br />it is necessary to change immecliafely the rate methodology to .clarify that exemptions or <br />reductions do not apply to road or administrative components of the stormwater charges. The <br />City will impose the new rates as of November 1, but may not send out the bills to heretofore <br />exempt properties until December, 1994 or January, 1995; in this event, the bills will reflect <br />amounts commencing November 1, 1994. <br />F. Failure to act promptly in effecting this clarification will prejudice the City's <br />implementation of the proper stormwater customer charges. <br />Administrative Order - 1 <br />
