ADMINISTRATIVE ORDER NO. 58-95-03 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED INDUSTRIAL PRETREATMENT <br />PROGRAM FEES " <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 6.546 of the Eugene Code, 1971 authorize the City Manager of <br />the City of Eugene to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, and licenses and permits, and specifically charges aril fees to be <br />paid by the industrial users of the City wastewater system who are subject to the provisions of <br />Sections 6.501 to 6.596 of the Eugene Code, 1971. In accordance with the procedures set forth <br />therein, I intend to establish fees for: (a) annual industrial discharge permit; (b) filing an appeal of <br />an administrative penalty; and (c) recovery of time and resource costs associated with resampling <br />violations, as set forth in the Notice of Intended Fees attached as Exhibit A hereto and <br />incorporated herein by reference. <br />B. I find that the fees set forth in Exhibit A hereto are consistent with applicable <br />policies and directives of the City Council, including those developed during the Eugene <br />Decisions process, and the provisions of Section 6.546 of the Eugene Code, 1971, that requires <br />fees be established that reduce the City's costs associated with setting up and operating the <br />pretreatment program; establishing sampling, monitoring, inspection, and surveillance procedures; <br />reviewing accidental discharge procedures and controls; and processing permit applications, and <br />should become effective June 1, 1995. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Counci~nrs, published in <br />the Register Guard, a newspaper of general circulation within the City, posted at two locations at <br />City Hall, and be made available for inspection by interested persons at the oi~ces of the City, <br />Manager, 777 Pearl Street, Eugene, Oregon 97401 during normal business hours (8:00 a.m. to <br />5:00 p.m., Monday through Friday, exclusive of holidays). <br />2. All persons desiring-Yo comment thereon shall submit written comments as set <br />forth in the Notice.
