~,
E. There are currently two classifications to the MWMC Equalization Fee. The Residential
Fee is applicable to single family residences and residential uses of up to two dwelling units, with the `
fee being based on the number of dwelling units in the development.. All other uses are classified as
Commercial/industrial. For newly developing Commercial/Industrial property, the fee is currently ,~`
calculated based on the number of plumbing fixture units in the development. The fee for existing ~~.,_,
ComrnerciaUlndustrial property connecting to the sanitary sewer system for the first time is currently
calculated based on the amount of water used by the existing development.
F. A one-time credit for MWMC fees is available for newly connecting property within the.
City and for property outside the City. The amount of credit for newly connecting property within the
City is based on the date of annexation to the City, the date of construction of any improvements
since 1978, and the current value of the land and improvements. For development outside the City,
the credit is based on the date of assessment for the sewer, the date of construction of any
improvements, and the current value of land and improvements.
G. MWMC has requested a revision in the MWMC Facilities Equalization Fee and Credits, as
provided in EC 7.075(2), for the fiscal year beginning July 1, 1996, and I find the proposed MWMC
Fees and Credits, as set forth in Exhibit A hereto are established in an amount designed to equal the
amount existing system users have paid for reserve capacity since 1978.
H. I find that the proposed revisions to the City of Eugene SDC Methodology to establish a
large volume wastewater user classification, as set forth in Exhibit A hereto, provides a method of
equating the impact of the large volume wastewater users with the City's dwelling unit based SDC
structure.
L I find that the automatic adjustment to the City of Eugene SDC Fees, as set forth in
Exhibit A hereto, should be effective July 1, 1996 pursuant to the 1993 SDC Methodology.
J. I find that the proposed revisions to the MWMC Equalization Fees and Credits, and the
City of Eugene SDC Methodology and Fees, as set forth in Exhibit A hereto are established in
conformity with applicable state law, adopted City policies, guidelines, and ordinances, including
Sections 2.020 and-7.710 of the Eugene Code, 1971, are comparable. and generally below the fees
charged by other jurisdictions, and I therefore intend #o establish the MWMC Facilities Equalization
Fees and Credits, and amend the cunrently effective City of Eugene SDC Methodology, as set forth in
Exhibit A, to be implemented effective July 1, 1996.
On the basis of these findings, I order that:
1. Copies of the Notice be provided.to the Mayor and City Councilors, published in the
Register Guard, a newspaper of general circulation within the City, posted at two locations at City
Hall, and be made available for intere~teci persons at the offices of the City Engineer, 858 Pearl
Street, Eugene, Oregon 97401 during normal business hours (8:00 a.m. to 5:00 p.m., Monday through
Friday, exclusive of holidays).
2. Alt persons desiring to comment thereon shall submit written comments as set forth in the
Notice. I will thereafter establish the fees by an administrative order.
Dated this 8th day of May, 1996.
v Linda H.
