ADMINISTRATIVE ORDER NO. 58-97-02 <br />of the <br />City Manager Pro Tem of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF SYSTEMS <br />DEVELOPMENT CHARGE METHODOLOGY <br />The City Manager Pro Tem of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager <br />of the Ciry of Eugene to determine and set fees and charges to be imposed by the City for <br />services, goods, use of municipal property, and licenses and permits, and specifically systems <br />development charges. Section 7.710 of the Eugene Code, 1971 further authorizes the Ciry <br />Manager to adopt and/or amend by administrative order, the methodologies used for establishing <br />the systems development charges, and provides this may be effected concurrent with the <br />establishment or revision of a systems development charge. <br />B. In accordance with the procedures set forth therein, I intend to amend the Systems <br />Development Charge Methodology by: (1) increasing the SDC rate structure to respond to the <br />increased costs of constructing public facilities to serve new development; (2) reformatting the <br />SDC Methodology document to improve its readability and simplify the update process; (3) <br />revising some practices such as elimination of SDC credit for private stormwater detention <br />facilities, increasing the length of time that private impact mitigation facilities must remain in <br />operation to qualify for SDC credit, reducing the threshold when a change of use will result in <br />collection of transportation SDCs, and placing a cap on the administrative charge that may be <br />collected; (4) decreasing the percentage rate used to calculate the administrative charge from <br />.7.25 % to 5 %; (5) modifying the annual inflation adjustment process by broadening the source <br />information used to address annual inflation adjustments to the rates to include local information <br />in addition to the past exclusive use of the national construction cost index; and (6) modifying the <br />method for calculating regional wastewater SDCs to include a new "large volume user" <br />classification in response to a resolution passed by the Metropolitan Wastewater Commission, all <br />as set forth in the Notice of Intended Amendment of Systems Development Charge Methodology <br />attached as Exhibit A hereto and incorporated herein by reference. <br />C. I find that the revisions to the Methodology and the fees as set forth in Exhibit A <br />hereto are consistent with adopted policies and ordinances of the City, in conformity with <br />applicable state law, and should be implemented effective March 1, 1997, and Administrative <br />Order Nos. 58-96-06-F-1 and 58-96-06-F-2 and any other orders in conflict therewith repealed <br />as of that effective date. <br />On the basis of these findings, I order that: <br />Administrative Order - 1 oui~is~ <br />
