:'ADMINISTRATIVE ORDER NO.'S8-97-02-F-2 <br />of the <br />City. Manager of the City of Eugene <br />AMENDMENT OF SYSTEMS DEVELOPMENT CHARGE METHODOLOGY. <br />The City Manager of the City of Eugene .finds as follows: <br />A. Sections 2.020 and 7.705 of -the ,Eugene Code, 1971 authorize the .City Manager <br />of .the City of Eugene to determine and. set fees and charges .to be imposed by the .City far <br />services, goods,. use of .municipal property, and licenses and permits, and specifically systems., <br />.development charges. Section 7.710 of the Eugene Code; 1971. further authorizes the City <br />Manager to adopt and/or amend by administrative order, the methodologies used for establishing <br />the systems development charges, and provides this may be effected .concurrent with the <br />establishment or revision of a systems development charge. <br />B. In accordance with the procedures set forth therein, on January 17, 1997, <br />Administrative Order No. 58-97-02 was issuedby the City.Manager.Pro Tem, and the Mayor and <br />Council were notified that the City Manager intended to amend the Systems Development Charge' <br />Methodology by: (1) increasing the SDC rate `structure to respond to the increased costs of <br />constructing public facilities to serve new development; (2) reformatting the SDC Methodology <br />document to improve its readability and simplify the update process;' (3) revising some practices, <br />such as eliminating SDC credit for private stormwater detention facilities, increasing the length <br />of time that private impact mitigation facilities must remain in operation to qualify for SDC credit, <br />reducing the threshold when a change of use will: result in collection of transportation SDCs, and <br />placing a cap on the administrative charge. that may be collected; (4) decreasing the .percentage <br />rate used to calculate the administrative charge from 7..25 % to 5 %; (5) future adjustments will be <br />completed pursuant to EC 2.019 and 2.020; and (6) modifying the method for calculating regional <br />wastewater SDCs to include a new "large volume- user." classification in response to a resolution <br />.passed by the Metropolitan Wastewater Management Commission, all as set forth in the. Notice <br />of Intended. Amendment of Systems Development Charge Methodology. attached as Exhibit A <br />thereto and incorporated therein by reference. <br />C. The Notice was published onJanuary 21, 22, 23, 24, and 25, 1.997, in the Register. <br />Guard, a newspaper of general circulation within the City, posted at four public Locations on <br />,January' 21, 1997,, and copies of the. Proposed Systems Development .Charge Methodologies; <br />March 1, 1997, were made available for inspection by interested persons at City Hall, the City <br />Public Works Building Lobby, 858 Pearl Street, Eugene; Oregon 9740.1, the Permit and <br />Information Center Lobby, and .the: Eugene Public Library during normal business hours. (8:00 <br />a.m. to 5:00 p.m., Monday through. Friday, exclusive of .holidays, except for the Library). The <br />,- Noticeprovided that written comments could. be submitted thereon for-a period of 30 days from <br />the date of posting and first date of publication. <br />D. No comments were received on the proposed adoption of the Regional Wastewater <br />Administrative Order - i oai9i9~ <br />
