ADMINISTRATIVE ORDER NO. S ~3- ~ 7 -O <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED CONSTRUCTION WITHIN AND USE OF <br />THE PUBLIC WAY PERMIT FEES AND AMENDMENT OF THE RIGHT-OF-WAY USE <br />PERMIT FEES SCHEDULE ESTABLISHED BY ADMINISTRATIVE ORDER 58-96-13-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Pursuant to the provisions of Sections 2.020 and 7.300 of the Eugene Code, 1971, on <br />July 16, 1996, the City Manager Pro Tem issued Administrative Order 58-96-13-F establishing a fee <br />for long-term use of the surface of the public right-of--way, adopting a revised right-of--way use <br />permit fee schedule, and repealing Administrative Order No. 58-94-O1-F, all as set forth therein. <br />B. Section 7.300 of the Eugene Code, 1971, which was recently revised, authorizes the <br />City Manager to establish fees for implementation of the City's program for construction within and <br />use of the public way. It would be more efficient to consolidate those right-of--way cut permit fees <br />with the previously established right-of way use fees in one schedule. <br />C. I find that the proposed increase in excavation permit fees and new right-of--way cut <br />permit fees for construction within and use of the public way set forth on Exhibit A hereto are <br />consistent with applicable policies and directives of the City Council, including policies developed <br />through the Eugene Decisions process, are based on the City's estimate of the costs associated with <br />providing the services, and are necessary in order to implement newly revised provisions of the <br />Eugene Code, 1971 and recover these costs from the beneficiaries of the services. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, posted at two <br />locations at City Hall, be made available for interested persons at the offices of the City Manager, <br />777 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m., <br />Monday through Friday, exclusive of holidays), and published in the Register Guard, a newspaper <br />of general circulation within the City. <br />2. All persons desiring to comment thereon shall submit written comments as set forth <br />in the Notice.
